Police Report: Volusia County, Florida - On June 24, 2023, while on patrol, I observed a dark-colored passenger vehicle stopped on S. Florida Avenue just north of W. Beresford Avenue. As I passed the vehicle, it proceeded to move southbound and I observed a black male walking away from the vehicle. I turned around and attempted to catch up to the vehicle. The vehicle was speeding and running stop signs prior to activating my emergency lights or even getting close to the vehicle. Once I was able to get closer, I observed the vehicle run several other stop signs and drive at an unsafe high rate of speed. At that time, I notified dispatch of the vehicle and proceeded to activate my lights and sirens. The vehicle failed to stop and continued to flee, all the while driving recklessly. I did witness the vehicle go through several stop signs at high speeds, run countless red traffic signals, drive on the wrong side of the roadway around curves, and speed excessively at times over 100 mph. I did attempt to pit the vehicle but was unsuccessful due to speeds and the driver taking counteractive measures to cut me off to avoid the pit maneuver. The vehicle went into the Meadowlea Estates, a residential trailer park, at which time I deactivated my lights and sirens and blocked the single entry/exit until another unit arrived and took over that post. With the permission of Unit #342, I continued to BOLO the area. The vehicle was located at the registered owner's residence within approximately 5 minutes of losing sight of the vehicle. The registered owner and elderly homeowner, (REDACTED), was asleep at the house when I arrived and did come out to speak with me. She stated that another female who she believed to have been home had a key to her vehicle and commonly drives it and her around town. The vehicle was still hot to the touch at this time. She allowed the Deputies of the Volusia County Sheriff's Office and me to enter her home and look for the possible driver. There was one female located in a bedroom in the house, on top of the covers in a back room. The white female appeared awake and had a racing heartbeat, as evident by the rapid rise and fall of her chest observable through her tank top. I asked her about the car, to which she originally stated she knew nothing about. She was unable to advise who took the car last. Her story could not provide a sound reason as to who was driving the vehicle and who she loaned it out to if anyone. I asked the white female if she had a driver's license, to which she provided a FL ID CARD number. The female was identified as Tracey Stewart. Stewart was asked to come outside to speak with me, to which she agreed. I read her Miranda rights at approximately 3:00 AM and questioned her about the vehicle. Stewart admitted to driving, driving recklessly, and recalled where she first saw my patrol vehicle and other facts of the events that only the driver would have recalled. Stewart admitted to being the only one in the vehicle and admitted to knowing the black male on the side of Florida Avenue. Stewart said she panicked and that's why she didn't stop. Based on the aforementioned information, I have reason to believe, and do believe, the defendant: - Violated Florida state statute 316.1935.3 [Flee and Elude Law Enforcement] as a result of failing to stop for a marked FHP patrol vehicle with lights and sirens active and eluding capture. - Violated Florida state statute 316.192.1a [Reckless Driving] as a result of witnessing the driver drive at high rates of speed in excess of 100 mph, run multiple stop signs, red lights, and drive with disregard for self and others. - Violated Florida state statute 322.03.1 [Operate Vehicle with No DL] as a result of not having a driver's license and driving a motor vehicle. ✅ This video obtained via Public Records Request Disclaimer: This video contains police footage that may depict individuals who have been arrested or charged with a crime.
