#ParkerKingston texts with friend: "He didn't know if he was going to crack her." 4 days later: "No male DNA was detected in the kit. The alleged victim as on her period." The following is a summary of the investigation conducted by a detective from the St. George Police Department regarding an alleged sexual assault involving Mr. Kingston.Initial Case Background The detective, Cody Leon, was assigned to the case on May 27. The incident allegedly occurred on February 23. The victim sought a sexual assault exam at St. George Regional Hospital on February 27, four days after the alleged incident. Officer Ken Childs took the initial report at the hospital, documenting that the victim reported being sexually assaulted at her apartment. A "SANE" (Sexual Assault Nurse Examiner) nurse performed the examination. The victim initially requested to restrict the assault kit, but later signed a release, allowing the detective to review the report, which indicated the victim stated the act was non-consensual. Investigative Steps Forensic Interview: After the victim contacted the police to proceed with the case, the detective arranged a forensic interview at the Washington County Attorney's Office, which he observed via webcam. DNA Evidence: The assault kit was sent to the state crime lab, but the results, received approximately seven months later, did not detect any male DNA. The detective noted that the four-day delay in reporting and the victim's menstrual cycle at the time of the exam may have impacted the results. Digital Evidence: The detective served a search warrant to Snapchat to recover communications between the victim and defendant; however, no messages were recovered due to Snapchat's retention settings and the fact that the parties had blocked each other. A search warrant was executed for Mr. Kingston’s phone, which was seized by the BYU Police Department in late November. The detective successfully extracted data from the phone through the Utah Tech University forensics lab. Digital Evidence Findings The detective recovered the victim's Snapchat handle saved in the defendant's phone and one message sent via Snapchat. The detective also recovered text messages between Mr. Kingston and a friend from the day of the incident. Based on these messages, the detective concluded that Mr. Kingston intended to engage in sexual intercourse with the victim. The detective testified that the defendant used the slang term "cracked" to refer to sexual intercourse, noting that the defendant messaged his friend "Just cracked her, bruh" after the alleged incident.
