-San Diego, CA. -August 11, 2023. A video released Monday shows a police officer shooting a car burglary suspect who fired a handgun during a foot pursuit in University City. San Diego police said Officer Joseph Lee fired his gun at Justin Teague, 39, early the morning of Aug. 11 after Teague shot at the officer outside a parking garage on Lebon Drive, south of Nobel Drive. The officer was not injured, and the gunman survived his injuries. The county Sheriff’s Department is handling the investigation under a reciprocal agreement with San Diego police meant to ensure that neither department investigates its own officers or deputies when they shoot someone. the incident started after police received a call from a security guard at an apartment complex who said two men were breaking into vehicles in a nearby parking structure. “They broke in; they broke into the car,” the security guard tells a dispatcher in an audio recording played in the Police Department’s video. When officers arrived on scene, they parked their vehicles to block off anyone from driving out of the parking structure’s only exit, text in the video reads. The video then cuts to Lee’s body-worn camera footage as he’s getting out of his vehicle at the parking structure. A Ford F-150 pulls in front of the officers. Its tires screech as the driver attempts to leave. Lee is shown running into the parking structure along with other officers. His handgun is drawn. “Get on the ground, get on the ground now,” another officer in the parking structure is heard yelling. Lee runs through the parking structure, between multiple parked cars and up a short flight of stairs leading to an outdoor path behind the structure. He continues to yell at a fleeing man, later identified as Teague, to get on the ground. The officer informs dispatchers that he’s in a foot pursuit. He after the man, down a winding path through the apartment complex. After turning a corner, Lee continues to chase after Teague and yell at him to get on the ground. After about 40 seconds, the suspected car burglar can be seen on camera. The Police Department’s video freezes the picture to show what investigators say is Teague turning around with a handgun in his hand. A gunshot can be heard in the distance. Seconds later, Lee slows his run and raises his handgun. A light shines momentarily on Teague who appears to be several yards away from the officer down an outdoor pathway. The officer fires his handgun, shooting multiple rounds, the video shows. Teague falls to the ground. Lee takes cover behind a staircase and loads a fresh magazine into his handgun. Another officer approaches him from behind. “Is he down?” the off-screen officer asks. “He’s down,” Lee responds. The video continues to show Lee with his gun trained in Teague’s direction, who is now lying on the ground a short distance off in the dark. Text in the Police Department video says officers yelled commands at Teague for two minutes to crawl away from his gun. Teague can be heard moaning. “If you need help, move away from the gun,” one of the officers can be heard yelling. After confirming with one another that it is safe to approach, the officers approach the wounded man. They handcuff Teague and begin administering medical aid. Teague was then taken to a hospital. The handgun’s action was jammed by a misfired round during the foot pursuit, text in the video reads. Lee has been with the department since December and is assigned to patrol in Northern Division.
