On Tuesday, November 19, 2024, at approximately 08:02 hours, Officers Clark and Osborne were on routine patrol around 14th St. when they observed a gray Kia with Florida license plates making a U-turn. The vehicle had heavily tinted rear passenger and rear windows. While in a marked Key West Police Department patrol vehicle, Officer Osborne initiated a traffic stop for this violation by activating the emergency lights and pulling the vehicle over in front of lot. He activated his body-worn camera as he approached the driver’s window. Officer Clark informed Officer Osborne that the registered owner of the vehicle had a suspended license and there was a prior incident involving this vehicle. Officer Osborne introduced himself to the driver, later identified as Jean, the registered owner, using his Florida driver’s license. Both Officers Clark and Osborne were in full Key West Police Department uniform, with their badges displayed. After explaining the reasons for the stop, Jean became argumentative, insisting that only the driver and passenger windows needed fixing and that everything else was fine. A female passenger was seated in the front, later identified by her driver’s license. Officer Osborne repeatedly requested Jean to present his license, registration, and proof of insurance, but he defiantly claimed he only needed to show his license. In a state of agitation, he started the vehicle. Officer Clark issued loud, lawful commands for Jean to exit the vehicle multiple times due to his refusal to provide the necessary documents. Despite these commands, Jean continued to resist and argued defiantly. Officer Clark then unbuckled Jean’s seatbelt and informed him that he was under arrest, but Jean still refused to exit the vehicle. Officer Clark attempted to pull Jean from the vehicle to effect the arrest, but Jean actively resisted, gripping the steering wheel with his right arm. Officer Osborne assisted Officer Clark in pulling Jean out of the vehicle. He was placed in a straight arm lock and then a hammer lock, but continued to pull away from them. Fortunately, there were no injuries reported during this interaction. During the struggle, they discovered a notice of suspension that Jean had received from the Department of Motor Vehicles on October 28, 2024. This notice indicated that his license would be suspended as of November 18, 2024, due to failure to pay child support. Officer Osborne placed Jean under arrest and transported him to jail. At his request, his vehicle was turned over to Marie, the passenger in the vehicle. Later at the jail, Officer Clark attempted to explain the citations to Jean, who claimed he did not speak English in a mocking manner. However, he communicated with them in English the whole time. Given the totality of the circumstances, Officer Osborne found probable cause to charge him with the following offenses: one count of driving while suspended with knowledge, as he acknowledged his license was suspended due to the DMV notice; one count of resisting without violence for his active physical resistance while Officer Clark attempted to remove him from the vehicle; and one count of refusal to accept and sign the citation for the tinted windows violation. #bodycam #police #cops #bwc #policebodycamera #copcam #copcar #arrest #arrested #bwc The individuals featured in these videos are to be considered innocent until proven guilty in a court of law.
