On August 21, 2024 at approx. 0035 hrs. I Sergeant Mullner was conducting speed enforcement on 1-285 east @ 1-75. within the boundaries of Clayton County, Ga. As I was conducting speed enforcement using a certified Lidar unit, I observed a vehicle traveling eastbound at a high rate of speed. I checked the speed of a 2007 BMW 6501 at 113 mph in a 65 mph zone. I activated my emergency lights and siren to conduct a traffic stop. The driver failed to yield and sped up reaching speeds over 130 mph. The driver fled on I-285 EB switching in and out of lanes attempting to elude. The driver exited onto 1-20EB and continued at a high rate of speed once again exceeding the speed limit traveling over 130 mph. As we approached I-20 @ Evans Mill Rd., the left rear tire blew and the BMW came to a stop shortly after riding on the rim. Once the vehicle came to a stop, the driver fled on foot and jumped off the I-20 EB / Evans Mill Rd underpass which is an approx. 80 foot drop injuring (breaking )his left ankle. I immediately advised Clayton County dispatch on his doings and to start an ambulance. The driver identified as BERRY, DELAUN still tried to crawl away , as I yelled for him to stop moving due to his unknown injuries from the fall. AMR Ambulance service arrived along with Dekalb County Fire shortly after. Berry was transported to Grady Hospital via ambulance. He was conscious, alert and breathing. A GICIC/NCIC check on the driver BERRY, DELAUN revealed that he has a suspended drivers license for serious violations under 21, violation date 10/23/2020 with a suspension date of 09/15/2021. The drive out tag that is displayed on the vehicle also comes back to a 2018 Nissan Pathfinder. A GCIC/NCIC VIN check on the BMW revealed that the vehicle is also not insured. Berry also has four outstanding warrants through four different jurisdictions. Berry is wanted by the Troup County Sheriffs Office for FTA original charge Simple Battery FV, Bartow County SO for Theft of Services, Walton County SO for FTA on traffic charges and Rockdale County for concealing stolen property. Due to Berrys injuries he was released on charges. I Sgt. Mullner took out warrants signed by Clayton County Magistrate judge Parker.
