On the morning of April 23, 2023, a lone employee was working at a Subway in Las Cruces, New Mexico, about an hour and a half after opening, when a man who had been circling the parking lot came inside with his face covered. He displayed a handgun for a moment, told the employee to put the money in a bag, and took the register cash along with the store's change bag. Before leaving he told the employee not to call police for ten seconds, then wiped his fingerprints from the door handle on the way out. Officers located the vehicle a short time later and a pursuit followed onto Interstate 25. The pursuing officer broke it off when traffic became heavy. Both occupants were detained on foot a few minutes later. What follows is the part these recordings rarely show: a long, candid conversation in the back of a patrol car, and then two interviews in which the same rights are read to two people who make opposite choices about using them. Source agency: Las Cruces Police Department, Las Cruces, New Mexico. Reported charges: armed robbery, NMSA 1978 30-16-2, and aggravated fleeing from a law enforcement officer, NMSA 1978 30-22-1.1. This is public police body camera footage obtained through a public records request. We add commentary and analysis explaining what is happening and the law behind it. The footage has been edited and condensed for length. The order of events is preserved. The search warrant footage near the end was recorded twelve days after the arrest, and its date is visible on screen. Names have been left out of the title and thumbnail, and identifying details spoken on camera have been removed from the audio. We obtain footage like this through public records requests.
