Officer Roybal’s Report: On March 1, 2024, I was on duty, in my full NMSP uniform displaying my badge of office. At approximately 0225 hours, I was patrolling on Montgomery Blvd eastbound and Monroe St NE when I observed a white Chevy SUV traveling while under the speed limit at 15 MPH , posted speed limit is 35 MPH. As I approached the vehicle the driver came to a complete stop in the #3 lane of travel eastbound on Montgomery. I turned my emergency equipment, and conducted a traffic stop. As the driver pulled into the parking lot, they went into the lane to the left of them putting the driver-side tire over the dotted line, and took a wider-than-normal turn to go into the parking lot. The driver slowly pulled into the parking lot taking longer than normal to come to a stop. I contacted the driver through the driver-side window. I identified the driver to be John William Mares by his NM driver’s license. I noticed the driver's speech to be slurred and he still had his vehicle in drive I had to ask him more than twice to put the vehicle in park. I asked Mr. Mares to give me his driver’s license he had a lot of trouble finding it. Due to Mr. Mares's driving and trouble following simple instructions, I asked him to step outside of his vehicle so I could conduct Standard Filed Sobriety Tests (SFSTs). Mr. Mares refused to step out of his vehicle, placed his vehicle in drive, and drove away from the stop without being allowed to do so. Mr. Mares drove through the parking lot and then got back onto Montgomery Blvd westbound driving at 25 and 35 Miles Per Hour (MPH). I followed behind without my emergency equipment on. Mr. Mares drove his vehicle onto I-25 southbound and continued southbound from MP 228 to MP 217 at speeds of 55 MPH to 62 MPH. While traveling southbound on I-25 Mr. Mares could not maintain his traffic lane of travel going from left to right. Mr. Mares would slow and then speed up again and change lanes periodically as we traveled southbound on I-25. Mr. Mares took the Gibson exit as he took the turn off. He then continued eastbound on Gibson at approximately 26 MPH posted speed on Gibson is 40 MPH. I pulled forward in the #3 lane of travel to attempt to set up a tire deflation device. As I was in the #3 lane of travel Mr. Mares went from left to right into my lane of travel almost striking my marked patrol vehicle and then returned to his lane of travel. Mr. Mares then did a U-turn and went westbound on Gibson. Mr. Mares then got back onto I-25 southbound. Mr. Mares pulled to the left shoulder and continued southbound, refusing to come to a stop. As we approached the 215 MP NMSP Sergeant LaFave attempted to set up a tire deflation device but was unsuccessful. Mr. Mares refused to stop, he went from the exit lane across all lanes of travel and took the median to go back northbound on I-25. I pulled slightly ahead of his vehicle and deployed a tire deflation device; it was successful in deflating the driver-side rear tire. Mr. Mares continued northbound, refusing to stop for me. The rear driver’s side wheel began to smoke as Mr. Mares refused to come to a stop and continued northbound on I-25. NMSP Sergeant LaFave deployed a second set of tire deflation devices at approximately the MP 221 successfully deflating the driver's side front tire. Both driver’s side wheels were smoking from being deflated, but Mr. Mares still refused to come to a stop. As we reached the Lead and Coal exit Mr. Mares took the exit crossing over the solid white line from the #3 lane over to North Oak St. As we approached Lead, I performed a Prevention Intervention Technique (PIT) Mr. Mares sped up after the PIT and continued northbound on Oak going through a solid red light that changed to green as I went through the intersection. We then approached Coal, Mr. Mares drove through a solid red light and was attempting to get onto I-25 northbound I performed another PIT maneuver to bring Mr. Mares's vehicle to a stop. The vehicle came to a stop just north of Coal on the east shoulder of Oak. NMSP Officer Pakfar, Officer Rodriguez, Sergeant LaFave and I performed a high-risk traffic stop. Mr. Mares got out of his vehicle from the driver-side seat, still not listening to commands to put his hand up and walk backward in Sergeant LaFave's direction. Mr. Mares then started throwing items out of his vehicle and his pockets. After a short period, Mr. Mares was placed under arrest. I read Mr. Mares his Maranda Rights and he stated he understood. Mr. Mares stated that he took about half of the syringe of what appeared to be by my training and experience heroin. From what was thrown close to where Mr. Mares was standing were three blue pills in a plastic bag of what appeared to be fentanyl. Mr. Mares was taken to the NMSP office for processing where he refused to be tested. After completing the paperwork about his arrest Mr. Mares was taken to the Prisoner Transportation Center (PTC) where he was accepted without further incident.
