On February 10, 2022, a Cibola County Sheriff's deputy working with a federal drug task force made a routine traffic stop on Interstate 40 in Cibola County, New Mexico. What he found inside that white Dodge minivan was anything but routine. Seven duffel bags stuffed with hundreds of pounds of marijuana with a total street value of over one million dollars. The driver, a 25 year old drug courier, was cooperative during the stop and even acknowledged the presence of the contraband inside the vehicle. The bodycam footage captured the entire encounter from start to finish. What happened next is where this case takes a turn that most people simply cannot believe. Despite the staggering amount of drugs seized, the suspect was never booked, never charged, and never spent a single night in jail. There is no mugshot, no court record, and no bond amount because the case never made it that far. The reason comes down to one very specific federal law that most people have never heard of. Because the deputy who made the traffic stop worked directly with the federal drug task force, the case was immediately handed over to federal prosecutors rather than being processed at the state level. Federal drug trafficking laws require a minimum of 1,000 pounds of marijuana for prosecutors to move forward with charges. The driver was carrying 468 pounds, less than half of the federal threshold. Federal prosecutors reviewed the case, declined to prosecute, and the suspect was released on the side of the highway with no charges filed. Had a regular county deputy without federal task force ties made the exact same traffic stop, the outcome would have been completely different. The suspect would have been arrested on the spot, booked into the Cibola County jail, and faced serious state drug trafficking charges that carry significant prison time. Under New Mexico state law, drug trafficking convictions can result in anywhere from three to thirty years in prison depending on the quantity and circumstances. But because the case entered the federal pipeline first, state prosecutors never got the opportunity to act. This case has been described by Cibola County Sheriff Tony Mace as one of the most frustrating outcomes he has ever witnessed. The million dollar marijuana seizure was ultimately destroyed, and the driver walked away completely free. It stands as one of the most unusual legal loopholes ever captured on police bodycam footage, a situation that was simultaneously too large for local law enforcement to handle and too small for the federal government to pursue. 👉 Subscribe for more real police bodycam footage, arrests, and criminal investigations.
