They were responding to a car crash. Patrolman Williams arrived first. He saw a black 2003 Ford Escape crashed into a dumpster. The driver was 24-year-old Sarah Budney. She told him she had been drinking. Sarah could not explain how the crash happened. She did not know what time it was. Williams suspected she was impaired and asked her to do sobriety tests. He started with the Horizontal Gaze Nystagmus test. Sarah failed. He then tried the Walk and Turn test. She failed that too. For her own safety, Williams stopped the tests. The crash, her confession, and the failed tests led to her arrest for DWI. Eagle Towing took her car for a 12-hour hold under John's Law. Williams took Sarah to the Parsippany Police Department. At the station, police read her the Standard Statement for Motor Vehicle Operators. Sarah said she would give breath samples. She failed to provide enough samples after several tries. Police charged her with a refusal. Her father signed a Potential Liability Warning form, and she was released to him. Williams gave Sarah tickets for: Operating under the influence (39:4-50) Reckless driving (39:4-96) Refusal to submit to chemical test (39:4-50.4A) Consent to take samples of breath (39:4-50.2) Failure to observe traffic control device (39:4-81) As of April 29, 2026, Sarah is still waiting for her court date.
