ROCK ISLAND, IL - At 9:55PM on January 19th, 2020, Rock Island Police arrived on scene to a wrecked vehicle with air bags deployed and the driver still inside. The suspect called his son and asked for help before the officer told the suspect to hang up the phone so he could speak to him. The suspect closed his car door in response. The officer went back to the suspect, reopened his door, and ordered him to end the call so he could speak with him. When the officer asked how much alcohol the suspect had consumed, he admitted to drinking "one or two or three drinks" in the night. A second officer on scene informed the first officer that the suspect's license was suspended. The second officer asked the suspect how much he had to drink and he claimed he had only one beer and he had slipped on ice while driving. The officer informed the suspect that they would be going to the station to test his abilities to determine if he would be safe to drive. The suspect agreed then asked the officer if the officer himself would be driving his car. The officer told the suspect that his vehicle that he crashed was not able to be driven. The suspect claimed that he had no drug paraphernalia on his person before stepping out of his vehicle. Following a search, the suspect claimed that he was "pretty sure" that he had previously been arrested for driving under the influence. At the station, the suspect admitted to having a suspended license due to not paying insurance. The suspect claimed that he had no vision problems that would have stopped him from performing a horizontal nystagmus test (out of frame, redacted). The officer observed that the suspect had distinct nystagmus and was unable to smoothly follow his pen. During the walk-and-turn test, the suspect struggled while following instructions, did not touch heel-to-toes, did not walk in a straight line, and was observed swaying while take steps. The suspect asked the officer several times if he was serious on whether he had to perform anymore tests to which the officer responded, "This is what we have to do." For the one leg stand test, the suspect indicated that since he went to work at 4AM that morning, he may be unable to perform the test. The officer asked the suspect if he was too tired to perform the test, but the suspect did not answer the question. Shortly after, the suspect agreed that he could do the test. While the suspect attempted to balance on one leg, he extended his arms to balance and still was unable to perform the test. After the suspect determined that he would be unable to perform the test, he stated that he would rather perform a breathalyzer test than continue testing whereupon the officer arrested him for driving under the influence (DUI).
