A patrol officer observed a black sedan rapidly accelerate away from a green light, reaching speeds up to 70 mph in a 35 mph zone. The officer watched the vehicle swerve out of its lane multiple times and brake suddenly to avoid another car. Upon initiating a traffic stop, the sedan's front tire drove up onto the curb before coming to a complete stop. When the officer approached, the driver fumbled with paperwork for nearly 40 seconds without noticing the officer shining a flashlight into the vehicle. The driver then struggled to roll down the window because the vehicle's ignition had been turned off. The officer noted the driver had bloodshot eyes, slurred speech, and a strong odor of an alcoholic beverage. The driver admitted to consuming three to four tequila sodas earlier in the night. The driver was asked to step out of the vehicle to perform standard field sobriety tests. The driver struggled to maintain balance, stepped off the line, and failed to follow directions during the assessments. These charges are merely accusations and the defendants are presumed innocent until proven guilty. An arrest is not a finding of guilt: that’s something for a court to decide.
