The footage presented in this video is for educational and informational purposes only. It is not intended to ridicule, shame, or defame any individuals involved. All content complies with applicable laws and is shared in accordance with fair use principles, where applicable. Viewer discretion is advised. On the 2nd of November 2016, two Police officers from Local Traffic and Highway Patrol unit conducted a traffic stop on a vehicle with unregistered plates. They approached the vehicle letting the driver know that the Roads & Traffic Authority (RTA) records state that the plates were expired and canceled due to it being a while since its last renewal. Usaully when you have canceled plates you have to surrender them to the RTA office. The officers started removing the plates as the dashcam footage started. The woman who was the driver of the red Peugeot starts speaking to the officers saying that “Why don’t you go and pick up ice dealers and paedophiles?” The officer replied to her, saying “That’s not our job,” warning her again to stop swearing. The driver was already cautioned at earlier during the dashcam video to watch her language and to not swear in a public place; this traffic stop took place outside a school. The officers tell her not to drive again, or she may be charged (she can drive for only emergency reasons.) She slams the trunk door muttering a swear word that is Unauditable. This is where officers paced back over to the driver and placed her under arrest; she initially seemed confused and passively resisted (Passive Resist: meaning that the arrestee is unaware or didn't hear the commands of an officer.) They placed her under arrest in such a manner that the state's Law Enforcement Complaints Commission had their own words to say. She was arrested with a degree of force that was not compliant or conducted in line with the Law Enforcement (Powers and Responsibilities) Act 2002 (NSW). This complaint was submitted by the driver of this traffic stop in 2018. The motorist was taken to the police station, charged and then released. The motorist complained that she had been assaulted by Officer A in the course of her arrest. Whilst being handcuffed by Officer A, the motorist’s head made contact with the body of the motor vehicle. The arrest was captured on the police vehicle in-car video (ICV). LECC Chivero, (2019.) The LECC found both officers engaged in “serious misconduct” and should be considered for disciplinary action, having breached sections of the Police Act, the NSW Police Code of Conduct and the Law Enforcement Act.
