On March 19, 2023, Westlake Police Officer Giraldo observed a driver make a left turn and cross over marked lines on the roadway (she turned from the outer turn lane into the inner lane). He began following the vehicle and allegedly observed numerous fluctuations in the driver's speed. He conducted a traffic stop on the vehicle and the 23 year-old driver admitted to drinking one Stella Artois beer. Officer Giraldo requested the driver step out the vehicle and perform standardized field sobriety exercises. When it got to the point of conducting the one leg stand, she refused to perform the test, citing that she was unable to stand on one leg for an undetermined amount of time. She was arrested for Operating a Vehicle Impaired (OVI) and transported to the Westlake police station. She refused to submit to an evidentiary breath test (EBT).
