On March 30, 2024, officers responded to a dispatched call about a fight between a male and a female. They found a parked car with three 19-year-old women, an open container of alcohol, and one subject who would soon be screaming "He's arresting me dad!" into her phone while invoking a lawyer who was not yet on scene. In this analysis, we examine the step-out authority of Pennsylvania v. Mimms and Maryland v. Wilson, the unambiguous-invocation requirement of Davis v. United States, the probable-cause standard of Maryland v. Pringle, and the misdemeanor arrest authority of Atwater v. Lago Vista. We also examine two notable discretion decisions by the officer — declining to charge DUI and declining to charge resisting arrest. ⚖️ LEGAL AUTHORITIES CITED - Adams v. Williams (1972) - Pennsylvania v. Mimms (1977) - Maryland v. Wilson (1997) - Davis v. United States (1994) - Edwards v. Arizona (1981) - Berkemer v. McCarty (1984) - Maryland v. Pringle (2003) - Atwater v. Lago Vista (2001) - Pennsylvania v. Muniz (1990) - Graham v. Connor (1989) ⚠️ DISCLAIMER This video is for educational purposes only and does not constitute legal advice.
