On 07/30/2023, a Florida Highway Patrol trooper was dispatched to assist regarding a report of a wrong-way driver. Upon arrival, the trooper observed a blue Volkswagen Tiguan facing the wrong direction on a sidewalk. Accordingly, the defendant, Ms. Yurisan Rojas, driving the wrong way on US-1. She eventually ended up on the sidewalk. Upon interacting with Ms. Rojas, the officer noticed that she had watery eyes and appeared confused. Her responses were slow and sluggish. The officer requested her driver's license, registration, and insurance. Ms. Rojas initially searched for her license, forgetting that she had already handed it to other trooper. She then provided a random piece of paper and a debit card as her registration. During the conversation, Ms. Rojas mentioned she was coming from Ft. Lauderdale but pointed in the wrong direction. The officer detected a strong smell of alcohol near her. The officer asked Ms. Rojas to step out of her vehicle and move to the front of the patrol car. The odor of alcohol was noticeable on her breath. The officer explained that they suspected her of driving under the influence (DUI) and proposed conducting a Standardized Field Sobriety Test (SFST). Ms. Rojas initially agreed to the test. While waiting for another unit to arrive, Ms. Rojas exhibited mood swings, going from calm to agitated. She attempted to return to her car multiple times but was directed to stay in front of the patrol car. When she tried to walk back to her vehicle again, the officer gently grabbed her arm to guide her back, but Ms. Rojas resisted by pulling her arms away. The situation escalated, and the officer had to use more force to detain her and put handcuffs on her. She was subsequently arrested for DUI and obstruction without violence. Despite her resistance, the officer managed to place her in the back of the patrol car with the assistance of another officer. Ms. Rojas agreed to provide a breath sample for alcohol content testing, and she was transported to a facility for this purpose. She provided two breath samples, which showed alcohol concentrations of 0.208 and 0.217. Ultimately, Ms. Rojas was taken to the Plantation Key Detention center after the arrest.
