The car continued east along NE Colorado Street. St. Andre tried to stop it but soon realized he was following the wrong vehicle. He shut off his emergency lights, drove south on NE B Street, and saw the Cruze traveling the wrong way on NE Linden Street. St. Andre turned his lights on again and stopped the car near NE Campus Street and NE Thatuna Street. The driver was later identified as 22-year-old Maggie Rash. When St. Andre reached the car, he asked Rash whether she knew why she had been stopped and whether she remembered running the stop sign. Rash said she was driving her boyfriend's car and did not have identification. St. Andre saw signs that she might be impaired, so he asked how much alcohol she had consumed. She first said "not very much," then admitted she had three drinks. He asked her to get out of the car and offered her field sobriety tests. Rash first took the Horizontal Gaze Nystagmus test. St. Andre saw that her eyes failed to move smoothly and jerked when she looked to the side. During the Walk and Turn test, she had trouble placing her heel against her toe and made an incorrect turn. On the One Leg Stand, she lost her balance, put her foot down three times, and used her arms to steady herself. St. Andre then asked Rash to take a Preliminary Breath Test. The result showed a blood alcohol concentration of 0.188%, more than twice Washington's legal limit of 0.08%. After seeing her struggle with the tests and fail the breath test, he arrested her for driving under the influence. He handcuffed her, placed her in the patrol car, and took her to the Pullman Police Department for further processing. At the station, St. Andre advised Rash of her constitutional rights. She waived them and agreed to answer his questions. He also read the Implied Consent Warning, and she agreed to provide breath samples. St. Andre began a 20-minute observation period. While waiting, Rash admitted she had been drinking earlier. The Alcotest later measured her BAC at 0.206%. After completing the breath test, St. Andre placed Rash in a holding cell. She was brought out a short time later for photographs and fingerprints. He charged her with driving under the influence under RCW 46.61.502 and released her. Rash was ordered to appear in court in Colfax. If you enjoyed this BodyCamBust video.
