PEPPER PIKE, OH - At 5:06AM on April 4th, 2020, a Pepper Pike Officer approached a vehicle with extensive damage disabled in the middle of a parking lot. The suspect and driver of the vehicle indicated that his car had been having mechanical issues and that his car had died on him in the parking lot. The officer told the suspect that his vehicle's tires were off the rims and that his car was completely immobile. The officer accused the suspect of hitting a telephone pole to which he did not respond. The officer asked the suspect how much he had to drink in the evening to which he replied, "a little sip." The officer asked the suspect to perform a finger count test. The suspect showed proficiency in the test. The officer next asked the suspect to recite the alphabet starting with the letter "D" and ending with the letter "T." The suspect showed significant signs of impairment and was unable to do so while counting several letters multiple times and stopping at the letter "P." The officer asked the suspect to count from 84 to 69 whereupon the suspect counted past and stopped at the number "68." The suspect then told the officer, "I'm not drunk." The officer asked the suspect how much he had to drink again and the suspect told him that he had two drinks. The officer then took down the suspect's information. When asked by the officer where the suspect believed he was, he indicated that he was at The UPS Store parking lot located in a bordering municipality. The officer asked the suspect to step out of the vehicle and immediately started a horizontal gaze nystagmus test. The suspect was unable to follow instructions and repeatedly moved his head even after being told not to do so. The officer then demonstrated how to perform the walk-and-turn test to the suspect. The suspect was observed struggling to understand what the officer was instructing while claiming that he understood. The suspect proceeded to stumble consistently moving forward with his arms extended for balance. The suspect turned around and did not attempt to touch heel to toes on the way back. The suspect was off line throughout the exercise. The suspect claimed that he understood the instructions being given to the officer because he was in the military to which the officer responded, "I was too." For the one leg stand test, the suspect struggled to balance while standing on one leg. The suspect extended his arms for balance and did not count beyond nine before replanting his foot. The suspect was subsequently arrested for operating a vehicle under the influence (OVI). The suspect began complaining that his job was essential to feeding veterans. While in custody, the officer showed the suspect the damage he had done to his car to give him insight on why he would have been unable to get to work due to not having transportation. The suspect then began to go on a significantly long and wide-ranging rant regarding the inner-workings of the United States while simultaneously telling the police he had to go to work later in the morning to "feed veterans." Once the suspect was at the cruiser, the officer searched the suspect. The suspect had nothing of evidentiary value on his person. The officer then placed the suspect in the police cruiser and read him his Miranda rights. At the station, the suspect submitted a .154 g/210L breath alcohol content (BrAC) sample into a breathalyzer and was charged with OVI.
