Incident Report Case No: 11-24-001854 Date/Time: November 11, 2024, at approximately 0300 hours Location: 1353 Brockett Road (Strokers Club) Reporting Officer: Officer Johnson, City of Clarkston Police Department While performing extra-duty security at Strokers Club, I was positioned inside my marked patrol vehicle when I overheard a verbal altercation emanating from within the establishment. I immediately entered the club to investigate. Upon entry, I observed a male later identified as Bernell Tolbert, engaged in a verbal dispute with club security and management regarding a payment issue involving a dancer. After a brief exchange, the manager requested that Mr. Tolbert be removed from the premises and not return. Mr. Tolbert complied and exited the location. When asked, the manager initially declined to pursue further action. As I observed Mr. Tolbert walk toward his vehicle, the manager reapproached and informed me that a dancer had alleged Mr. Tolbert physically assaulted her by choking her approximately 10 to 15 minutes prior. Based on this new information and probable cause, I approached Mr. Tolbert, who was attempting to enter the driver’s side of his vehicle. I instructed Mr. Tolbert multiple times (approximately ten commands) to step away from the vehicle for questioning. He refused to comply, claiming he had done nothing wrong and expressed fear of police. His behavior became increasingly nervous and evasive, consistent with someone intending to flee. I radioed for backup due to his non-compliance and body language suggesting flight risk. Upon arrival of backup units, I attempted to physically detain Mr. Tolbert by grasping his shoulders. He fell into his vehicle, then quickly closed the door and fled on foot, slipping out of his shirt in the process. I maintained pursuit as he ran west toward Brockett Road. Believing Mr. Tolbert posed a public safety risk—due to the alleged assault, active resistance, and the proximity to the Chevron Gas Station with patrons present—I deployed my department-issued Taser 7 near the grassy area by the parking lot entrance and Brockett Road. The use of force was ineffective, as later medical evaluation confirmed the Taser prongs failed to make contact. Mr. Tolbert continued fleeing across Brockett Road to the rear of the Chevron station, where he attempted to climb a fence. Sergeant Hilton intercepted him, pulling him down. While officers attempted to detain him, Mr. Tolbert actively resisted arrest by concealing his arms and rolling on the ground. During the struggle, Mr. Tolbert bit my right hand between my thumb and index finger, causing a minor puncture wound. After approximately ten minutes and with additional officers’ assistance, Mr. Tolbert was successfully restrained. EMS was requested and responded to evaluate Mr. Tolbert for any injuries sustained during the incident. I returned to Strokers Club to conduct a follow-up investigation. The dancer involved, identified as Kirbee Archie, provided a witness statement, alleging that Mr. Tolbert initially placed his hands around her neck in what appeared to be a flirtatious manner but escalated to a choke hold from behind. She described feeling distressed and stated that a security guard intervened. The security guard, Jason Roberson, also provided a corroborating statement. He observed Mr. Tolbert's actions escalate and noted Ms. Archie's visible discomfort and distress. He witnessed Mr. Tolbert lifting Ms. Archie off the ground by the neck before intervening. Following the altercation, Ms. Archie requested payment from Mr. Tolbert, which led to the initial dispute I had observed. All witness statements were collected and scanned into the case file. Mr. Tolbert was transported to Emory Decatur Hospital for medical evaluation by Officer Brown, and upon medical clearance, he was transferred to the DeKalb County Jail
