#news #police #arrest #cops Report: On 08/15/2022, Officers were flagged down in reference a Blue Toyota 4Runner suspected to be involved in a hit and run. Officers attempted to make contact with the Toyota by knocking on the glass window and the driver drove off. Officers were able to get behind the vehicle and activate my emergency lights and the vehicle eventually stopped. Officers approached the driver window and officers could instantly smell the odor of an alcoholic beverage. The officers asked the driver why she didn't initially stop, she stated that there was a guy behind her acting weird trying to "f with her". Officers kept asking for her to explain what she meant and she just kept repeating the same thing. She also kept repeating that she is just trying to go home. At this time the suspect was asked to step out of the vehicle and she complied. While the suspect was standing outside of the vehicle she kept swaying trying to keep her balance. She eventually swayed so much she stepped forward and touched me. The officer observed her eyes to be red and glossy as well as smelling an odor of an alcoholic beverage coming from her breath. Any questions officers asked the suspect, they had to ask multiple times to get any type of answer. The officers asked where she was coming from and she had difficulty answering the question. Officers explained to her that her eyes are red and I can smell alcohol coming off of her breath and told her to be honest. She stated that she maybe have had two beers way earlier in the day approximately 4 hours ago. The officers asked if she would let me check if she is okay to drive and she agreed. At this time field, sobriety tests were conducted and she removed her glasses. She stated that she could see my stimulus just fine. During Standardized Field Sobriety Tests, officers observed the following.... Horizontal Gaze Nystagmus (HGN): ● Equal tracking and pupil size observed in both eyes ● Lack of smooth pursuit observed in both eyes ● Distinct Nystagmus at max deviation observed in both eyes ● Onset Nystagmus prior to 45 degrees observed in both eyes During the first set to check for Equal tracking, she moved her head multiple times, I told her to keep her head straight and she stated that it's difficult to do. Officers began the test again and she kept moving her head again. Officers had to keep reminding her to keep her head straight as she would move it side to side as my finger went by. Walk and Turn: ● The suspect could not make it past the instructional phase of the test. She kept saying that this is crazy and she stated that she is a ballerina. She stated that she is not drunk, officers even had the suspect take her sandals off and she still could not get into the instructional position. The suspect could not simply put her right foot down and touch it with her left foot touching heel to toe. A search incident to arrest was conducted on her person and vehicle. A box that stated, "Malbec Chile Wine" that appeared to be half empty was discovered inside of the vehicle. Two closed Miller Lite 16 oz cans were also Iocated in a cooler in the backseat. A driver history was conducted on the suspect and her record shows she pleaded guilty to a DUI in 2018. The suspect was transported to the County Jail. Due to some confusion during the investigation between officers she only recieved a citation for DUI. She had failed to maintain lane during her turn and left the scene of the accident making it less safe for her to drive.
