TATMAN, ND - On May 20th, 2020 at 12:08AM, a deputy with the Ward County Sheriff's Department responded to a call about a vehicle stopped in a slough. Upon approach, the suspect appeared to be asleep and was unresponsive when the deputy made verbal contact. Eventually the suspect woke up and appeared unaware of the situation. Another deputy requested the suspect to step out of the vehicle to which he complied. Once outside the vehicle, the deputy asked whether or not the suspect would be willing to participate in field sobriety tests whereupon the suspect declined doing so. The officer then read the North Dakota Implied Consent Advisory for a preliminary breath test to which the suspect refused. The suspect was then arrested for DUI – Refusal. Once in custody, the suspect was read the North Dakota Implied Consent Advisory for a chemical breath test to which he again refused. Before being searched prior to being placed into the patrol vehicle, the suspect had to be restrained against the squad car because he began pulling away from the deputy while in custody. Once in the back of the patrol vehicle, the suspect intentionally hit his head against the rear passenger window. The suspect was warned that if he continued to do behave in that manner that he would be hobbled. The suspect then again hit his head against the window a few more times and was subsequently hobbled. During the search of the vehicle, the suspect again began hitting his head against the window of the squad car. The suspect stopped this behavior once the deputies threatened to hogtie him. The suspect was eventually taken to the Ward County Jail for further processing.
