A 7-Eleven employee in Darby Beach, Florida stole nearly $15,000 over one month by fraudulently loading gift cards at the register — then pretended she couldn't speak English when police arrived to arrest her. Was the Miranda advisement legally sound? Did the language barrier request hold up in court? We break it all down. WHAT HAPPENED Franchise owner Russell noticed repeated inventory shortages totaling nearly $15,000. Surveillance footage captured employee Tamara loading $400 onto a gift card with no customer present and pocketing it. Officers from the Darby Beach Police Department were called, conducted an on-site Miranda advisement, and arrested Tamara on the spot. LEGAL ISSUES COVERED Miranda v. Arizona (1966) — when rights advisement is required and what makes a waiver valid United States v. Garibay (9th Cir. 1998) — why partial English comprehension does not satisfy the knowing-and-voluntary standard Frazier v. Cupp (1969) — why "why did you steal" is legally different from "did you steal" Berghuis v.
