On January 25, 2025, an Ohio State Highway Patrol trooper stopped a vehicle for speeding after clocking it at 51 mph in a 25 mph zone. The driver, a 19-year-old college student, told the trooper she was the designated driver for her friends and insisted she had not been drinking. She claimed the odor of alcohol inside the vehicle was caused by her passengers, all of whom admitted they had been consuming alcohol earlier that night. During the traffic stop, the trooper observed indicators of impairment and asked the driver to step out of the vehicle to perform standardized field sobriety tests. Despite repeatedly denying that she was intoxicated and stating she felt capable of driving, the driver agreed to participate in the tests and later consented to a portable breath test. The result showed a blood alcohol concentration of 0.191%, more than double the legal limit for drivers over 21 and nearly ten times Ohio’s legal limit for underage drivers. The driver was placed under arrest and transported to the Ohio Highway Patrol post, where she submitted to an evidential breath test. The official test confirmed a BAC of 0.175%, indicating she was still absorbing alcohol into her system. While seated in the back of the patrol car, she repeatedly stated she was not drunk and criticized the trooper for not focusing on “real drunk drivers,” despite the breath test results.
