On the above date and time I, Ptl. Stilton, was on uniformed patrol in marked unit 2789 traveling south on Northwest Central Avenue. On this day, I was the officer in charge. While traveling south, I observed headlights facing my direction due to a vehicle driving the wrong way towards me. The vehicle was approximately four blocks from my location. I initiated my lights for the vehicle to see, but they continued traveling north. I then initiated my emergency sirens for the driver to hear where they would pull out of the roadway within a short distance of my vehicle. There were other vehicles on the roadway traveling the same direction as I was. I initiated a motor vehicle stop on this vehicle being a white, 2015 Infiniti Qx6. I approached the driver‘s side door to speak with the driver later identified as Christa. I advised her the reasoning for the stop being that she was driving on the wrong side of the road. Christa handed me her insurance card and driver's license which were valid. I asked her for her registration afterwards which she handed to me. While speaking with Christa I detected the odor of an alcoholic beverage emanating from her. Christa also spoke slow, quiet and would whisper to me. I asked her if she had anything to drink tonight where she stated, "I did have a drink or two.” I also observed that Christa was crying and I asked her if she was okay stating she was going through some personal matters. When asking what she had to drink tonight she said Titos and Club. I requested another unit to my stop where Officer Bruno and Officer Mortensen would arrive shortly after. Before their arrival I shut off the front emergency lights of my vehicle and requested Christa to step out of the vehicle. I escorted her to the front of my vehicle and advised her to stand there while awaiting other officers to arrive. While waiting, Christa explained that she could go back to her friend’s house and had left because she did not want to do certain things with that individual. I explained to her that she was driving on the wrong side of the highway where she responded that she didn't know Seaside Park. I advised her that right now I had a reason to believe that she was operating her vehicle under the influence of alcohol. She had advised me that she did drink tonight, the reason for the stop was driving on the wrong side of the road and that I would be running her through a series of Field Sobriety Tests. Horizontal Gaze Nystagmus: I utilized a pen to have Christa follow the stimulus during the medical test and advised her to not move her head after she had done it before I had advised her. I observed a lack of smooth pursuit in both Christa’s eyes. I also observed the onset of nystagmus prior to a forty-five degree angle and distinct and sustained nystagmus at maximum deviation in both of Christa’s eyes. Walk and Turn Test: I then instructed Christa to stand heel to toe while I explained the instructions. Christa then began the test where she failed to keep her hands at her side and took more than the instructed nine heel to toe steps. She also failed to turn on her left foot and continued to walk back towards me where I had to catch her as she began to fall. Christa was unable to count each step out loud as instructed. Christa failed this test. One Leg Stand Test: I explained the instructions to her that after I explained the instructions that she was to lift one foot, either foot, approximately six inches off the ground and to keep that foot parallel to the ground while counting one thousand one, one thousand two, one thousand three, and so on until I told her to stop. Christa then began the test where she lifted her left foot off the ground and failed to keep it parallel to the ground. She began to count to one thousand two where she then placed her left foot back down. Based on my training and experience and the failure to satisfactorily complete the Standard Field Sobriety Tests, I placed Christa under arrest for DWI. Upon arrival at Police Headquarters I escorted Christa out of the vehicle and into the booking room. Christa provided two valid breath samples to me as the Alcotest operator with a result of a 0.10% BAC. Afterwards, Elias made contact to her father to come and pick her up. He signed the Potential Liability Warning form and was also advised of the towing procedures. Christa was released from my custody at 01:68 hours after receiving her summonses and advised of court procedures. Court records show this case as pending and not yet resolved. ______________________________________________ All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq.
