On January 3, 2025, Las Cruces Police Officers responded to a traffic accident. According to witnesses, the 37-year-old driver of a Mercedes SUV run a red light and collided with a semi-truck. Officers observed that the woman had bloodshot eyes, slurred speech, and the odor of alcohol was coming from the Mercedes. She was asked to step out of her vehicle and refused several times. Officer Rodriguez had to reach into the vehicle and guide her out. Because she refused to perform field sobriety tests, she was immediately placed in handcuffs and arrested for Driving While Intoxicated. After being read the New Mexico implied consent law, the woman stated she would not provide a breath sample. She was transported to the emergency room for medical clearance and was then taken to the Dona Ana County Detention Center.
