On May 15th, 2023, Stuart Police officers were investigating a battery incident at a home when an unrelated confrontation suddenly broke out in the street. As officers approached, a 29-year-old man reached into his waistband and pulled out a black Ruger EC9 9mm pistol during an argument with another male. An officer was standing directly between both men when the gun was drawn. Officers immediately drew their weapons and gave repeated commands for the suspect to drop the firearm. After several orders, the suspect finally released the gun but continued moving with his hands near his pockets, forcing officers to maintain lethal cover. The suspect was ordered to the ground, handcuffed, and detained without further incident. The firearm he displayed contained a full magazine and had its safety off. Officers later confirmed the suspect possessed a valid concealed carry permit, but his actions still constituted a criminal threat. The suspect admitted he pulled the gun because he “didn’t want to fight,” while officers noted the weapon was displayed in a threatening manner and placed them in fear for their lives. He was charged with Aggravated Assault on a Law Enforcement Officer (F.S.S. 784.07) and Improper Exhibition of a Firearm (F.S.S. 790.10).
