On November 4, 2023, Belmar Police Officer Vojtko stopped a 25-year-old woman after allegedly seeing her drive the wrong way on a one-way street, run a stop sign, and nearly cause a collision. During the stop, Vojtko reported smelling alcohol coming from her vehicle. The woman claimed she had consumed only one glass of wine roughly an hour earlier. Officers asked her to perform a series of standardized field sobriety tests. She repeatedly questioned why she had been stopped, had difficulty following some instructions, and maintained that she had performed the tests successfully. Officers disagreed and placed her under arrest for driving while intoxicated. After being arrested, she refused to voluntarily enter the patrol vehicle and repeatedly demanded an explanation, forcing officers to assist her into the rear seat. At the police station, officers read her the required breath-testing statement. She initially agreed to provide breath samples but repeatedly demanded to make a phone call first. When officers told her the call would have to wait until processing was complete, she refused to proceed with the breath test despite being warned that doing so would result in a separate refusal charge. She was ultimately charged with driving while intoxicated, refusal to submit to chemical breath testing, careless driving, reckless driving, failure to stop at a stop sign, and driving the wrong way on a one-way street. On January 24, 2024, she pleaded guilty to the DWI charge, while the remaining five charges were dismissed. Her penalties included $1,105 in fines and court costs, 12 hours at an Intoxicated Driver Resource Center, and a requirement to install an ignition-interlock breathalyzer device in her vehicle. The case ultimately ended with a DWI conviction, while the other five original charges were dismissed.
