On September 29, 2019, in Park City, Utah, police officers responded to what was initially reported as a neighbor dispute. What followed was a tense and controversial encounter captured on police bodycam footage that continues to raise serious questions about police conduct, constitutional rights, and accountability. The video shows Park City Police officers entering the home of Michael Franchek without a warrant, leading to a heated confrontation and his eventual arrest. During the encounter, Franchek’s teenage son was present and recording the police, escalating concerns surrounding First Amendment rights and the treatment of minors during police actions. Following the arrest, Michael Franchek filed a federal civil rights lawsuit seeking over $1.1 million in damages. The lawsuit alleged illegal entry, excessive force, and violations of First Amendment, Fourth Amendment, and Fourteenth Amendment rights, including claims related to the handling of his son during the incident. Franchek also requested a public apology from the officers involved. An internal investigation into the Park City Police Department later found multiple policy violations. According to investigation findings, Officer Rodrigues violated police recording policy, prisoner management policy after leaving Franchek locked in a hot patrol car without air conditioning following a taser deployment, dependent child care procedures by failing to ensure a responsible adult was contacted, and report preparation standards by excluding or misrepresenting key details. Sgt. Thor was also found to have committed similar violations related to recording policy, prisoner management, and dependent child care. As a result of the incident, the entire Park City Police Department was required to undergo additional First Amendment training, specifically focused on citizens recording police and constitutional limits on police authority. Multiple outlets and Michael Franchek himself have stated that Officer Rodrigues and Sgt. Thor were fired after failing to complete corrective actions tied to the investigation. However, Park City Police dispute that claim, stating that discipline was handled internally and did not include confirmed terminations. Regarding the legal outcome, Michael Franchek’s original federal lawsuit was stayed by the court while related criminal matters were resolved and did not result in a public verdict or reported settlement. Years later, in 2025, his son, Jack Franchek, filed a new federal civil rights lawsuit against Park City and the same officers, asserting his own constitutional claims stemming from the 2019 encounter. That case remains active with no final ruling or payout reported as of now. This bodycam footage remains a powerful example of how quickly a routine call can escalate and why questions surrounding police authority, accountability, and constitutional protections continue to matter. 👉 Subscribe for more real police bodycam footage, arrests, and criminal investigations. ℹ️ Chapters: 0:00 Intro 0:22 Police Make Contact with Father 0:47 Police Enter Home 1:30 Taser Deployed 2:02 Father Arrested 3:30 Argument With Officers 17:19 Arrest Info & Mugshot 17:38 Bodycam Breakdown 20:24 Outro Disclaimer: This video contains footage of a real-life incident.
