On December 30, 2024, at approximately 0643 hours, Officers Clark and Sonnichsen were on routine foot patrol in Fort Village. They observed a known individual trespassing, despite having received prior warnings. The property was clearly marked with "No Trespass" signs at various entrances, and the Key West Police Department had permission to issue trespass warnings and remove individuals from all Key West Housing Authority properties. Officer Clark had previously received permission from the Housing Authority Manager to address trespassing issues in the area, which was known for illegal narcotics activity. As the officers approached, they detected the smell of a lit cigar and, upon rounding the corner of apartment 3G, Officer Clark recognized Arthur, a known narcotics offender currently on probation for drug sales. The Housing Authority had informed Officer Clark of complaints regarding possible narcotics activity at the apartment. Officer Clark had previously issued a trespass warning to Arthur on behalf of the Key West Housing Authority. Arthur was sitting on the front porch of apartment 3G when Officer Clark called out to him, asserting a commanding presence and indicating a desire to speak. In response, Arthur panicked, dropped what he was holding, and rushed inside the apartment, locking the door behind him. The sudden activation of lights inside the apartment suggested a state of alarm, possibly indicating the destruction of narcotics. Officer Clark monitored the front door while Officer Sonnichsen observed the rear. It is important to note that both officers were in full uniform with badges displayed, and Arthur was aware that he was committing a crime by attempting to evade law enforcement during a lawful investigation. Minutes later, Arthur exited the apartment and was taken into custody. Officer Clark had previously warned Arthur about trespassing on the property on November 24, 2024. The Key West Housing Authority had informed Arthur's mother that he was not allowed on the premises and had received complaints regarding his narcotics activity. A prior narcotics arrest at the same residence had occurred on December 29, 2024. Based on the facts and evidence, it was believed that on December 30, 2024, Arthur knowingly and intentionally violated Florida Statute 810.09(2)(b) regarding trespassing after warning, by entering and remaining on the premises despite multiple warnings. It was evident that he had to walk onto the property to access the residence.
