AMERY, WI - On June 27th, 2020 at 11:12PM, an Amery Police Officer observed a minivan traveling northbound on Harriman Ave without license plates. The officer turned his marked police squad car around and began following the vehicle in question. The officer activated his emergency lights and sirens to pull over the vehicle. The vehicle continued traveling on Harriman Ave below the posted speed limit until turning onto a dead-end road. As the driver stepped out the vehicle, the officer approached the suspect and began questioning why he did not pull over sooner. The suspect claimed that he did not see the lights. He further claimed that he did hear the sirens, but did not realize that the officer was trying to stop him. After confirming the suspect's information, the officer asked how much he had to drink. The suspect claimed that he had one beer three hours prior to being stopped. While processing the suspect's information, the officer learned that the suspect had five prior impaired driving convictions and that there was a warrant for his arrest in Washington County, MN. When asked about the warrant, the suspect claimed that he was not aware that one existed. The officer then began performing field sobriety tests (FST). Prior to the start of testing, the suspect claimed that his left ankle had been injured due to being a former professional high diver. During the horizontal gaze nystagmus test, the suspect displayed vertical nystagmus, lack of smooth pursuit, distinct and sustained nystagmus prior to 45 degrees, and distinct nystagmus at maximum deviation in both the left and right eye. For the walk-and-turn test, the suspect walked off line and missed touching heel-to-toe on several steps. During the one leg stand test, the suspect was unable to balance without extending his arms, did not count in one-thousands, and had to place his foot down to regain balance. This test was stopped due to safety reasons. Following the conclusion of the FST, the suspect consented to a preliminary breath test. The sample provided yielded a result of .186% breath alcohol content. The suspect was then arrested and transported to the Amery Hospital & Clinic after consenting to providing a chemical blood sample.
