MARTA POLICE CASE NUMBER: 202408318 BRIAN DONEICO CARTER Case number: 2401516 Arrest/Offense Date: Offense Date: 2024-01-26, Booking Date: 2024-01-27 On 01/26/2024 at 1928 hours while on train patrol at the MARTA West End Station, I was on the northbound platform on a call with a male subject I was issuing a MARTA Suspension to. While out on the call, an argument started between the male I was out with and Carter, Brian. Carter continued to be disorderly by arguing with the male who had ceased any communication with him. Carter was loud and continued to make a scene and even threatened the guy by saying he will seе him again. He would not stop being disorderly so Ofc. Marshall and Ofc. Taylor walked over to him to try to calm him down. He continued to yell and would not calm down. He was issued a verbal criminal trespass to leave by Ofc. Marshall several times. He did not leave. I noticed Carter had his hand inside his jacket pocket and he had a angry demeanor. I alerted Ofc. Marshall and Ofc. Taylor to watch his hands as Carter finally decided to walk down stairs. We made it downstairs to the north end of the station, near the Lee Street faregates, Carter kept his hand in his right jacket pocket. I advised units to watch his hands. After we tapped out the faregate, I advised Ofc. Marshall to stand back as we allowed Carter to walk off the property. Carter started to become disorderly again and started to verbalize threats by saying " Good because y'all was about to be a man down on his ass if he would have followed me all the way down here....You know what it is, I don't know why you capping for bro". As we started to walk back towards the station, Carter pulled a gun out his jacket pocket and pointed it at us. I drew my department issued weapon and took cover. He then fled the scene. I observed him walking down the sidewalk near the lot. I aimed in on him and gave him verbal commands to put his hands up. He did not listen to my verbals and continued to walk away with his hands in front of him. I pursued. I had a visual of Carter as he was walking on the sidewalk. I ran and took a angle slightly in front of Carter and gave him verbals again to get on the ground and to show me his hands. He continued to walk. I observed what appeared to be a gun in his right jacket pocket. The outline of the weapon was protruding from his jacket. I closed the gap between us and grabbed his right arm that was the closest to his weapon. I noticed he had some items in his left hand. As I lunged and grabbed him, I holstered my weapon with my finger outside the trigger guard at the same time and held him. I instructed my back up officers to grab the weapon out his jacket pocket. The weapon was taken from his right jacket pocket. I held him as officers placed handcuffs on him. Carter started tensing up and wouldn't let officers place his right hand in a handcuff. I then lifted up on his leg and performed a leg sweep and took him to the ground. Once on the ground, he continued to resist by moving his arm and trying to get up. I placed my knee on his upper abdominal area to ensure he remained still while we handcuff him. He turned his body and continued to move his hands. I gave him loud verbal commands to stop resisting. He continued to tense up as we were trying to get him turned around and handcuffs on. He was turned around facing us. I rest my hand on his upper chest area and held him down. He tried to get up. I held his arm so units could place handcuffs on, he tried to lift up again. As I was holding my hand on his upper chest area it slid to the base of his neck area as he continued to move around and lifted up. I instructed units to place the handcuffs in the front and immediately after the handcuff was placed on, I removed my hand and got from on top of him. He was helped to his feet. The weapon (.38 Special Smith and Wesson Revolver CTG serial # 630034) was retrieved. As the weapon was made safe, it was observed that no bullets were inside He was transported to Five Points Precinct by unit 3301 Cpl. Walters. He advised his leg was broken. An ambulance was started. Once at Five Points, he advised he needed assistance getting up the stairs into the precinct. I grabbed his legs and lifted him up the stairs. He was checked through GCIC/NCIC for active warrants/wants which returned negative. He was checked for MARTA Suspensions which returned negative. He was issued suspension notice #93204 and issued a permanent ban off MARTA. A Criminal History Check revealed that he was a convicted felon with multiple felony convictions. After clearance from Grady he was transported to Fulton County Jail by unit 314 Officer Richards. The weapon and his property was secured in locker C4 at five points.
