It moved at a crawl. He swung around in a U-turn. He caught up at Ocean Avenue and Beach Road. The swerving went on. He flipped on his lights for a stop. She pulled over near Ocean Avenue and Seacrest Road. He stepped out. He approached the driver: 25-year-old Marilyn Morales. While talking to her, he smelled alcohol. He saw signs of impairment. Marilyn said she came from Asbury Park that night. Her eyes were wet from crying. She claimed no drinks. Later, she added her boyfriend had dumped her. He suspected impairment. He had her step out for sobriety tests. First came the Horizontal Gaze Nystagmus test. Golembieski noted no smooth pursuit. Nystagmus jerked distinct at max deviation. It started before 45 degrees. Vertical nystagmus showed too. Next, Walk and Turn. She missed heel-to-toe steps. Wrong step count. Bad turn. Last, One Leg Stand. She didn't lift her foot right. She dropped it early. Erratic drive. Mumbled words. Booze smell. Failed tests. He arrested her for DWI. Her car got a 12-hour impound under John's Law. He took her to the station. There, they read the Standard Statement for drivers. She said, "Talk to Richard Nixon." They read it again. "Speak to my attorney," she replied. No clear yes. They marked it as breath test refusal. After processing, her mom took her home. Mom signed the liability warning. Court date ahead.
