On April 22, 2023, Elgin Police Officer Caliendo observed a vehicle traveling at 50 MPH in a 30 MPH zone. He initiated a traffic stop and what transpired must be seen to be believed. It is basically a textbook example of what not to do during a traffic stop. The 36 year-old woman was arrested and cited for the following violations: 1) 2 counts of resisting/obstructing a peace officer; 2) Driving under the influence; 3) Operating a vehicle with expired registration; 4) Speeding; 5) Illegal transportation of alcohol; 6) Operating an uninsured motor vehicle. The police report gives details of what happened after arrival at the Elgin city jail. "At the Egin Police Jail, she continued to be uncooperative with officers and was unable to be processed at that time. While speaking with Officer Banks, while sitting in our padded cell, [she] stated "I'm drunk right now" at approximately 0403 hours. Once hearing that utterance from [her], I made a note to refence for this report. [She] was placed in cell F2 to await processing. Once in her holding cell, I opened the food hatch to the cell and read her a warning to motorist form. After reading the warning to motorist form, I started my 20 minute observation period at 0500 hours. At 0520, my observation period concluded. During this time, she was laying in her cell bed and not responding to me. I asked [her] if she would consent to chemical testing, to which she laid in the cell bed and did not respond. I asked [her] a total of three times if she wanted to consent to chemical testing, all of which I received no response." "While speaking with [her] at approximately 11:00 AM, after she stayed in her cell since she was brought in, she seemed confused to what events occurred previously that led to her arrest. I explained that she was initially stopped for her speed violation and I observed the several open and empty containers of alcohol in her vehicle and could smell the odor of alcoholic beverages emitting from her person. Once I asked her to step out, she started resisting me and that there were several indicators that she was intoxicated. At no point during this conversation did I question her about the incident. While walking out of the Elgin police station, [she] told me she was drinking at the bar prior to the traffic stop, but stated that the open liquor in the vehicle was not hers." All suspects are presumed innocent until proven guilty in a court of law.
