On May 18, 2023, Fort Smith Police Officers responded to a motor vehicle accident. The woman who caused the crash was visiting Arkansas from Wisconsin and was driving a rental car. Officers discovered that she was incredibly intoxicated. She was asked to perform standardized field sobriety tests, but they were prematurely ended for the safety of the woman. She was arrested for DUI and transported to the police station. She was placed in a chair in the breath alcohol testing room and while the officer was out of the room, cameras captured the woman fall out of the chair. When the officer came back into the room to assist her, she claimed the officer pushed her out of the chair. She was subsequently given multiple opportunities to complete an evidential breath test, but she could not provide an adequate breath sample, and the test was deemed a refusal.
