I conducted a traffic stop on a vehicle observed speeding (33 MPH in a 25 MPH zone) and exhibiting poor lane maintenance. Upon interaction, I noted an odor of alcohol from the driver and observed hesitation when questioned about drinking. After administering the Horizontal Gaze Nystagmus (HGN) test, my sergeant confirmed sufficient clues for impairment. The suspect proceeded to fail the Walk and Turn and One Leg Stand tests, claiming physical impediments but showing general lack of attention to instructions. Based on the totality of the circumstances, I placed the suspect under arrest for Driving While Intoxicated (DWI). During processing at the station, the suspect was read the implied consent law regarding breath samples. Due to the suspect providing conditional and ambiguous answers rather than a clear 'yes' or 'no,' a second charge of Refusal to Submit to Breath Testing was filed. --------------------------------- All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq.
