A Florida traffic stop for speeding turns into a DUI arrest after the driver volunteers he has had six drinks since eight o'clock with no food, before the officer finishes asking. He agrees to field sobriety tests because he has done them before and he is from Wisconsin. He follows the HGN pen with his entire head. He takes eleven steps when asked for nine. He holds his finger on his nose waiting for permission to put it down. At the end he says he is more than comfortable to drive. He is arrested and seems genuinely surprised. He then gets his hand out of the handcuffs, head butts the patrol car, and spends the rest of the footage trying to arrange a pickup for his girlfriend in Fort Myers. This video examines why voluntary statements before custodial arrest are fully admissible, how the HGN test works and what officers are looking for, the Florida DUI statute and what impairment means legally, and what the conduct after arrest adds to the charge sheet.
