Wall Township, NJ On October 15, 2023, I, Ptl. Wheeler #209, was on duty for the Wall Township Police Department, working the day shift hours. I was in full police Class "A" uniform, operating marked patrol vehicle 94, equipped with a body-worn camera (BWC). The events described herein were recorded on my BWC, which was reviewed in preparation for this report. At approximately 1737 hours, I was traveling in the area of State Highway 34 south and Allaire Road, approaching the traffic circle with a Yield sign present. State Highway 34 is a two-lane road in both directions separated by a grass center median. The intersection with Allaire Road is managed by a traffic circle, marked with Yield signs for all traffic traveling on State Highway 34 south. There are also Yield signs for traffic on State Highway 34 Northbound. Traffic traveling in the circle has the right of way. I approached the yield sign and the circle, slowed my patrol vehicle to a stop in the left lane, and observed a vehicle making an illegal left turn from the right lane. Activating my emergency overhead lights, I observed the accused vehicle making a left turn into the circle from the right lane over a solid white lane line. The vehicle pulled over into the right shoulder and came to a complete stop. I then made contact with the occupants. I identified myself as a member of the Wall Township Police Department and informed the driver and front seat passenger the reason for the stop. I requested the driver's license registration and insurance. The driver was identified as Juliet. I received the driver's license and asked where they were coming from tonight. The front seat passenger hesitated before responding. The passenger responded and stated that they were coming from iplay America and that they were celebrating. The driver provided me with a digital copy of her insurance card, and I observed her drop some of her documents as she pulled her registration from the glove compartment. I detected the odor of an alcoholic beverage emanating from the passenger compartment of the vehicle. I asked the driver how many drinks she consumed today, and she quickly stated, "just two." When Ptl. Flores arrived on the scene, I made a driver's side approach and requested the driver exit the vehicle as I intended on completing Standardized Field Sobriety Testing on her. She exited the vehicle, and I directed her to the rear of the vehicle for testing. Upon speaking with her at the rear of the vehicle, I continued to detect the odor of an alcoholic beverage emanating from her breath. I then placed Juliet through standardized field sobriety testing. At the conclusion of these tests, I informed the driver that she was being placed under arrest for DWI. I advised her to turn and face away from me and face her vehicle. I placed her in handcuffs utilizing the double-lock. She was placed in the rear of my patrol vehicle. While transporting her, she made an unprompted utterance of remorse. Upon arriving at headquarters, I detected a strong odor of an alcoholic beverage that was not present before. I escorted her into headquarters, removed her handcuffs, and initiated the breath testing process. I read her the NJ Attorney General Standard Statement for Motor Vehicle Operations. At the completion of the ninth statement, she is required to give an answer regarding the submission of her breath for chemical testing purposes. Her response was "yea" at 1806 hours. I advised her not to place anything in her mouth during this time. During processing, I observed her place her necklace in her mouth subconsciously and restarted the 20-minute observation period at 1828 hours. After more than 20 minutes passed, Ptl. Alexander #183 responded to headquarters to complete testing on the Alcotest machine. Due to Alcotest guidelines, no electronic devices are allowed to be operated near the Alcotest machine. I removed my body-worn camera and checked myself and her for electronic devices before escorting her into the processing room 1920. She supplied two sufficient breath samples yielding a .178% BAC. See Ptl. Alexander's supplemental report for further. She was subsequently released to her sister Cassidy at 1920 hours on 10/15/23. She was issued the following citations: 39:4-50 DWI 39:4-96 Reckless driving 39:4-144 Failure to Yield ______________________________________________ All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (P.L. 2001, c. 404). Defendants are considered innocent until proven guilty. This channel is made strictly for educational and news gathering purposes.
