Description

Bodycam: a woman knocked over a stack of buckets at a Home Depot. That got her arrested. The suspected fentanyl in her pocket did not.

This is how "search incident to arrest" actually works. Any lawful arrest — no matter how trivial the underlying offense — authorizes officers to search your person and your bags with no warrant. A knocked-over bucket display was enough to unlock a full search.

What that search turned up never became a charge, and the reason sits in one of the strangest gaps in recent Washington law. After State v. Blake voided the state's simple drug possession statute, the legislature passed a temporary fix requiring officers to offer treatment twice before making a possession arrest. The City of Kent had passed its own drug ban four days before this arrest — but that ordinance did not take effect for another two months.

So the pills were destroyed at the scene. So were six debit cards found in her purse bearing other people's names.

⚖️ LEGAL NOTE: No conviction has been reported in this case. All charges described are allegations. The pills were destroyed and never lab-tested.
