First DWI: https://www.youtube.com/watch?v=l1DZO_QmD8M

Around 1:56 AM on March 9, 2025, Officer Alexander Triana with the Highland Park Police Department observed a black 2015 Volkswagen GTI speeding at 38 MPH in a 30 MPH zone in the area of Route 27 and South 1st Avenue. He followed the vehicle as the driver attempted to elude the officer. The driver eventually pulled in front of a barrier gate in the rear parking lot of 320 Raritan Avenue, and Officer Triana initiated a traffic stop. He exited his patrol car and made contact with the driver, who was identified as Kelly Horvath.

As he was speaking with Kelly, he detected the odor of alcohol and observed other indicators of impairment. Kelly told the officer that she was coming from Destination Dogs, a restaurant in New Brunswick. She admitted to consuming alcohol earlier that evening. Based on his suspicion of impairment, Kelly was eventually asked to exit the vehicle and perform field sobriety exercises after Officer Jonathan Laraj arrived on scene to assist.

Kelly’s poor performance on the field sobriety exercises confirmed the officers’ suspicion of impairment. Based on her erratic driving, the odor of alcohol, her admission to consuming alcohol earlier that evening, and her inability to satisfactorily complete the field sobriety exercises, Officer Triana placed Kelly under arrest for driving under the influence. Her vehicle was impounded for a mandatory 12-hour hold under John’s Law. Kelly was initially transported to the Rutgers University Police Department (RUPD) for the administration of the breath test.

At the RUPD, Kelly was read the Standard Statement for Motor Vehicle Operators, and she agreed to submit breath samples. Her Alcotest results indicated a BAC level of 0.205%, which was more than double the legal limit of 0.08%. Kelly was then transported back to the Highland Park Police Department for further processing. She was eventually released pending her court appearance.

Officer Triana issued Kelly the following traffic citations:
-Operating under the influence (39:4-50)
-Reckless driving (39:4-96)
-Speeding (39:4-98)
-Failure to maintain lane (39:4-88B)

On April 14, 2026, Kelly pleaded guilty to reckless driving, while the other 3 citations were dismissed as part of a plea agreement. As a result of her guilty plea, Kelly had to use an ignition interlock device for 2 years, spend 48 hours at an intoxicated driver resource center, perform 30 days of community service, and spend 2 days in jail. Kelly also had to pay a total of $990 in fines.

Kelly had previously been arrested for her first DWI in Plainsboro Township, New Jersey on August 26, 2022.

We are in compliance with YouTube's Fair Use Policy because we edit several long clips into a concise story. This is similar to other law enforcement channels on YouTube. All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (P.L. 2024, c.16). Defendants are considered innocent until proven guilty.

The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
