Description

An Illinois officer stops a vehicle for an expired registration and observes cannabis in plain view on the passenger seat. The driver's licence comes back suspended out of Missouri. Under Illinois law a Missouri suspension prevents driving in Illinois. The cannabis is in an open bag rather than the sealed dispensary container required by state law. The driver refuses to exit the vehicle when ordered and physically resists the arrest. She is cited for possession of cannabis in a motor vehicle, driving on a suspended licence, expired registration, and resisting arrest.
This video examines the plain view doctrine and why visible cannabis in a vehicle creates probable cause regardless of recreational legality, Illinois cannabis transport law and the sealed container requirement, why an out of state licence suspension applies in Illinois, Pennsylvania versus Mimms and the order to exit a vehicle, and how the officer's decision not to pursue obstruction charges reflects prosecutorial discretion at the street level.
