Around 3:09 PM on May 14, 2023, Patrolman Nathan Rucinski with the Hazlet Township Police Department responded to the southeast corner of Route 36 South and Union Avenue on a report of a driver who was asleep at the wheel. He arrived on scene, parked his car in front of the vehicle, and noticed that a male was asleep behind the wheel of a red 2023 Mazda. He made contact with the driver, who was later identified as Marcelo Campillay. He instructed Marcelo to put the vehicle in park and exit the vehicle.

Just 2 days prior, the same individual had been arrested for DWI in Red Bank, NJ after driving Marissa Haugh’s vehicle. Marcelo told Patrolman Rucinski that he was coming from his child’s game. Patrolman Rucinski instructed Marcelo to put the car in park and exit the vehicle. After Patrolman Connor Sheehan arrived on scene, Marcelo was escorted over to the parking lot of the nearby Burger King and asked to perform field sobriety exercises.

Marcelo failed to satisfactorily perform the field sobriety exercises. He initially denied consuming alcohol, but later admitted to consuming a few drinks earlier that day. Based on his erratic driving, the odor of alcohol, his admission to consuming alcohol, and his inability to adequately complete the field sobriety exercises, Patrolman Rucinski placed Marcelo under arrest for driving under the influence. The vehicle that he had been driving was impounded for a mandatory 12-hour hold under John’s Law. He was transported to the Hazlet Township Police Department for further processing.

At the Hazlet Township Police Department, Marcelo was read the Standard Statement for Motor Vehicle Operators, but he refused to submit breath samples. After the officers finished processing him, he was eventually released pending his court appearance.

Patrolman Rucinski issued Marcelo the following summonses:
-Operating under the influence
-Refusal to submit to chemical test
-Consent to take samples of breath
-Reckless driving
-Careless driving
-Delaying traffic
-Failure to observe traffic control device

Marcelo’s prior DWI arrests include the following instances:
-Red Bank, NJ on May 12, 2023
-Holmdel Township, NJ on January 18, 2023
-Red Bank, NJ (AGAIN) on October 5, 2022
-Marlboro Township, NJ on February 3, 2019

Following his fifth arrest, Marcelo was arrested for DWI yet again in Monmouth Beach, NJ on August 14, 2023. His girlfriend also has a record of 3 separate DWI arrests in Little Silver, Oceanport, and Shrewsbury.

We are in compliance with YouTube's Fair Use Policy because we edit several long clips into a concise story. This is similar to other law enforcement channels on YouTube. All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (P.L. 2024, c.16). Defendants are considered innocent until proven guilty.

The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
