It's up right now. >> So this guy, this guy's the one that I like they're hurt and they left. We're still here. Look at my truck. Look how how bad my truck is right now. >> How much you had to drink today, man? >> Uh maybe like three beers. That's it. >> How long ago was that? >> Uh like an hour ago. >> Okay. So, we're going to walk over here a little bit. >> Yes. >> Though he was crying with red, bloodshot, watery eyes, officers could clearly see he was drunk. His tears weren't for the victims fighting for their lives. They were only for his wrecked truck. >> You wear glasses or contact lenses? >> I have glasses in my truck. >> Okay. What do you wear them for? >> Uh for like seeing far away. >> Uh I can see better with them. >> Okay. All right. >> I can do it without them though. >> Your hands to your sides all the way in front. So your feet are in line just like mine. >> Yes. >> Your hands to your sides. You're going to stay just like this while I explain and demonstrate what I want you to do. Do you understand? >> Uh, can I ask you something though? >> What's up? >> This guy's just left like nothing happened to And then you're testing me like if I was my fault. >> I don't think it's fair that this guy's left like nothing and my truck's out and look at my truck. >> I I see I saw >> I I'm just hurt right now. >> I get it. I wasn't here for all that. >> Yeah. Oh, it's okay. >> You understand the instruction demonstration? >> Yes. >> Okay. Make sure you keep your hands to your sides for the entire duration of the test. And once you start walking, don't stop until you completed the test. >> Okay. >> So, go ahead and get back to your starting position there. Other way around. Right foot in front. Go ahead and begin. 1 2 3 4 5 6 7 8 [Music] >> I'm I'm scared right now to be honest. >> Okay. >> Do you want me to go back? [Music] All right, sir. >> So, right now you're under SPD ID. Did you turn on your transplant drive? >> Okay. [Music] Is there anything you need >> like your phone or anything like that? >> Um, I think I have my phone with me and my glasses. That's it. I didn't see your I didn't feel your phone anywhere. >> Uh, maybe in my pockets. I don't know. Maybe it's in my truck. >> Okay. Well, we're going to back come back here. Okay. All right, go ahead and have a seat for me. It's also cold as [ __ ] out here. [Music] What kind of phone is yours? >> It's an iPhone 13. >> What kind? >> What color is it? >> It's uh gold. >> It's this one here. >> Yeah, that's it. >> Yeah. >> How are you? You know, I was reading the CAD and I was on my way home and I was like, so I know that he got victim ID. He was working on getting the other passenger ID and he got the doctor's 43. >> And when officers finally booked him into the station, they informed him that one of the victims didn't make it. That's the moment his expression completely changed. So stay t >> All right, Brandon. So I'm going to give you a little bit better idea what's going on today. Okay. So I know you told officers that you didn't know what happened in the crash. So I'll explain it to you. So two cars are parked in the right shoulder cuz one of them was had a flat tire and they were changing the tire. You struck the rear vehicle which subsequently hit the front vehicle where two people were outside of that vehicle changing a tire. One of those individuals was killed as a result of their injuries that you caused during the crash. The second person is still in critical condition at UNM hospital with bleeding of their brain and multiple facial fractures. So today, you're being charged with one count of homicide by motor vehicle DWI and one count of great bodily harm by motor vehicle DWI. Currently, I'm uh awaiting approval on a search warrant to have your blood drawn to be tested for alcohol content and or drug content depending upon the results of alcohol content. So, as soon as uh I get that warrant approval, I have a phabotamist that'll come over here. She's going to draw your blood. Um that blood draw will be by the order of a judge. Okay? I know this is not pleasant and this is certainly not what you want to hear. I'm going to get you through this process as quickly as I can. you're going to get booked on those charges today. Um, you'll probably have to wait for a a first appearance in front of a judge. Um, probably not until Monday or Tuesday. Um, cuz the district court judges don't work over the weekends. Uh, and then, uh, the case will proceed from there. You'll have to get an attorney and and just follow whatever advice that they give you. Okay. Um, but that's kind of where we're at today. Um, so I will get my part of it done as quickly as I can so that this process will go as quickly as possible for you. Um, and and we'll go from there. Okay. If you have any questions along the way, I'll do my best to answer them. Um, and I can answer pretty much anything outside of an answer that would be construed as legal advice. Okay. >> You said I hate those guys, right? >> What happened? >> I hate them. Yeah, >> but my truck was never on the like on that lane. My truck was in the middle of it. >> Well, state police took the uh >> You got pictures, right? >> Well, state police is doing the accident investigation, >> but my my truck was never on the like in the hazard lanes, right? Like in the I don't know what that lane is called. The one that you go over to to Whatever. Change your tire or whatever. >> The shoulder. >> Yeah, the shoulder. My My truck was not there, right? >> Well, that's where your truck was when I got on scene. >> Really? >> Yeah. >> Was my truck there? >> Yeah. >> You got pictures of that? >> It's on camera. >> Okay. >> Raymond is charged with homicide by vehicle, great bodily harm by vehicle, and DWI. A second homicide charge could be added if the second victim doesn't survive. If you want more real cases like this, hit subscribe.
