He pushed me into the furniture and then on like the insides there's a little bit of indentations from my teeth. >> She's pissed because I took her vape as far as like everything in that house is my that she smashed smashed the lamp in my face. And >> it's just after 3:00 in the morning on March 27th, 2026 on State Route 54A outside Penyan, New York. Yates County deputies get sent to a domestic call. But the first thing this deputy checks isn't the broken lamp on the floor. It's the woman's mouth. He says she hit him first. She says it went a lot further than that. Before anyone decides who's walking out of that house tonight, deputies have to work out what actually happened in that bedroom. >> He meant something to me about a lamp. Did you hit him with a lamp? >> No. The lamp fell over when he pushed me into the furniture. >> Okay. >> Let me just take a look at your lip real quick. >> Yeah. >> Okay. And then on like the insides there's a little bit of indentations from my teeth. Okay. [music] Cuz he was got he got on top and started to smother her. >> Okay. With a pillow. >> No, with his hands. >> With his hands. Okay. Let me just take some pictures of your mouth real quick. [snorts] So, what started all of this? >> He's been drinking. Same thing always. Have you been drinking? >> No. >> Okay. >> Do you want to like >> Yeah. Put your lip out. >> You can just do the bottom one and then we'll do the top one. >> Okay. [music] >> Okay. Okay. So, you said he's been drinking and that's what started all of that. >> Yeah. >> How did you guys like get in a fight about him drinking? >> Um, it wasn't really a fight about him drinking. I went in So, I've been sleeping out here. [clears throat] M >> I went in there to get a couple of my things and he's been mad cuz he's drinking sometimes. He's just irrational when he drinks. And he shoved me into some furniture which included the lamp and like a table on top of a table which made all of that stuff fall to the floor. >> Okay. Okay. And so he pushed you because you went in and tried to get your things. What were you trying to get your things for? >> I just have some meds in there. I wanted to get my pajamas. Um >> were you trying to leave or you just trying to >> just trying to cuz we used to share that room together and now I'm sleeping out here but all my possessions are still in that room. >> Okay. Um earlier today he'd asked me to come back and you know resolve things but then he got really drunk and you know when he gets drunk he just gets >> really out of control and mean. And >> so you came back today? >> No, I've been here. I've just been sleeping >> here in the living room. Well on a mattress on >> Okay. Um cuz have you did you move out recent like previously? >> I did. >> Okay. And then you guys decided to get back together. >> Yeah. >> Okay. [snorts] All right. Um Okay. Are you willing to like sign a statement or anything like that? Like do you want to press charges against him tonight? >> Yeah, I have to. >> Okay. All right. >> I don't He's He's going to kill me like he keep hears promising to. >> Okay. [snorts] So, when he covered your mouth, how did he how did he [music] do it? >> Well, he had one hand over top of the other. >> Okay. >> And then I was struggling a bit and he ended up having kind of his fingers in my mouth and was pulling my mouth apart, but for a good 2 minutes, he had his hand over my mouth and I was really afraid. >> Okay. Were you able to breathe at all when he had your his hands in your mouth? >> Now he has very big hands, so they were kind of like shoved up against my nostrils. >> Was he trying to make it so you couldn't breathe? >> Yeah, I think so. >> Okay. [laughter and snorts] >> While he was doing that to you? >> Yeah. >> Or was it before that he did that? >> No, it was while he was doing that to me and then afterwards. >> Okay. Where was it that he did this at? >> Right in here. I was on the bed trying to like when he does he took all my things and shoved or threw them in there. Uh when he does this I try to keep him away from me. >> Mhm. >> So I had stuck my foot up in the air to just to try to put some space between me and him, but didn't [music] work this time. >> Okay. [snorts] And you said you haven't had anything to drink tonight? >> No. >> No. Okay. I don't drink. >> Okay. You did you get her information recently? No. >> Um so I'm going to do is I'm going to start on some paperwork. Um [music] I am going to have to have you come down and um I'm going to have you write a statement about um kind of what happened tonight and all that stuff. Do you want an order of protection against him? >> Can I get one tonight? >> Yeah. So, like if we if we get the statement that we get from you, um, and depending on what what we get from you and stuff like that, um, then we might be able to bring them in tonight and we can ask the judge in the morning to get an order protection for you if that's what you're wanting to do. >> [sighs] >> It's so hard, you know, but I think that because he he's threatened to kill me and it's not the first time and this time he actually made efforts to do so. I just feel like >> in order to protect myself, >> I probably need to. >> Okay. [snorts] All right. >> Do you need me to come down to the station or just come down to your car? >> Um, it would be just come down to my car. >> Okay. Yeah, because uh we don't do paper stuff anymore. Unfortely do it all through our computer. >> Um so if you want to come down to my car um and then we'll be able to type up stuff. Okay. >> Let me just put on this. >> That's fine. >> We should be okay. >> All right. >> Yeah, thank you. And so he threw the he how did the lamp get broken or how the lamp >> um it fell over when he threw me into the um when he threw me into the furniture. >> Okay. >> Like a bedside table there. >> Where is that at? >> I'll show you. >> So he like pushed you or how did he >> He pushed me into it. >> Okay. So, this bedside table had more stuff on it and a lamp on the top >> and he kind of tried to get rid of the evidence. >> Okay. >> Um but like all of this went toppling over with me and um that's when I ran out there. >> Okay. and [snorts] he chased me out here and tackled me down. And I'm sorry. This is probably like the fifth time you guys have been out here. >> No, it's okay. So, we can just walk right out here. And my car is right at the kind of at the end of the driveway here. >> Okay. Oh, it's really wet. >> Yeah. >> And if you want to just hang out kind of like right here, I'll pull my >> and like get in the other room. >> Yeah. >> In New York, cutting off someone's breathing is a separate crime called criminal obstruction of breathing. Deputies [music] treat a breathing complaint as a possible strangulation case because that's one of the clearest warning signs that a domestic situation can turn deadly. >> We're just going to we're just going to detain you. All right. >> Why? >> Just for now so we can go check on her. Okay. >> Just put your hands behind your back. >> Oh my god. You serious? >> Yeah. >> Just until they figure out what's going on. >> All right. >> Move your arm a little bit. Grab him. Or I can go check on her. She's out back. >> Okay. Yeah. >> You guys good with him? >> Mhm. >> You don't have anything in your pockets, right? >> I've got my pockets. >> You don't have pockets? Okay. If you just want to come over here, you're just going to just sit in his car real quick. >> Yeah. It's one two three. You just want to open your door just >> You just want to sit in there real quick. You don't have anything on you. >> I know. Just Can I pat you down real quick? >> You can. I've got >> What do you got in here? >> Say I have things in my pocket. >> Yeah. What do you have in your pocket? >> My phone, maybe. >> What's this right here? >> I don't know. Get it. It's your job. >> I know. But I don't have any weapons. >> I know. So that's what I That's all I'm looking for right now. I don't want to like be going through your pockets. >> You're going to be fine. >> Okay. Oh, just keys and cash. Okay. So, you're um just detained right now. Like you're not under arrest. So, like I can't just be like um really searching through your pockets. Oh, you just got your hides. Okay. Just say right there. >> Deputies don't need much to hold someone this way. Reasonable suspicion that a crime happened is enough to detain him. Well short of the probable cause it would take to actually arrest. >> Okay. So, what what happened tonight? >> She's pissed because I took her vape. >> Okay. Is it one of the ones that are in your pocket? No, there's another one. >> I gave it to her. >> Okay. >> She's flipping out. >> Okay. That's all that's been. >> And I've already we've already been arguing. >> So, like as far as like everything in that house is my [ __ ] Mhm. >> What about any physical contact between the two of you >> that she smashed? missed the lamp in my face and [ __ ] We had some physical time. >> Okay. How long ago? Well, >> a while ago, but I'm like, what the I started cleaning up all my mess. Took the vacuum cleaner out. Plants got like soil all over the floor, so I started cleaning. >> Started cleaning it up. >> Okay. >> I'm like, >> you ever put your hand? You ever put your hands on her? >> No. >> No. >> She didn't say so, but >> Okay. What would she say? >> She wants to be here. >> If you were to guess, >> I've been paying all the rent. >> Yeah, I got you. If uh if she was to say something happened, what would she say that happened? >> I got you. >> And everything in there is my >> If she's If she were to say, "Go stay with your parents. Get the out of here." >> Who are her parents? Why do I got to say that? Like what the is this an investigation? Like if you want to take me to jail and do [ __ ] I'ming this [ __ ] ising stupid. >> Well, it is an investigation cuz we got called. >> Guess what? Let's Let's take it from there. You want to take me to jail? Take me. I'll tell you what. If I miss work tomorrow, this ain't going to be able to pay the rent here. And guess what? Then I gotta deal with it with my family cuz her family's done with her. So it So that's where we're at here. Guess what then? Why? >> So >> my family will paying rent still and she got to get her the out and get out of here. >> Okay. Well, we have to do our due diligence before we can >> I'm done saying >> Okay. So you don't want to talk anymore? I got I mean I got cuffs on and I have no rights read to me, >> right? Because you got cam on, right? >> Yeah, you're just detained right now. >> Drug gun. >> All right, great. >> You know what? I've been detained plenty of time. [snorts] >> Transporting one male to the jail for spending a night in jail. Tell you what, be nice to see the old wholeing family there in YCJ. I don't really don't give a So, let's make it a real one. >> Well, we have to talk to her before we can do anything. And you just said that you don't want to talk. So, >> I don't know. I don't know what else >> I got to go. That's the way it is. >> You know what? She don't pay. >> Guess what? I don't give a >> We're not here about her paying. Exactly. That's the way it is. We'll come out and That's the way it will come out. I don't give a [ __ ] Take me to jail. I'll spend the night in the tank. I don't care. Stop asking me questions. You want to talk real [ __ ] >> What's real to you? >> I don't know. What's real to you? I don't know. Well, the reason the reason that we're here >> are you a real cop or you I don't really care. I don't I don't care anymore. I don't dig cops. I don't I can go to jail. You don't have to care about >> I don't care anymore. Not being nice. Say I got to go to work in the morning. This [ __ ] I don't know. until you find out. That's your job, not mine. >> Well, I'm sure my partners are figuring that out. >> All right, then go talk to her. You got to write it down. >> I can't do that because we're talking. >> Okay. >> Can't just leave you out here. >> Then just shut me in here. Lock me up. Stuff me in. Take me to jail. >> Well, everything you're just working it out in the wash. >> So, >> I'm not happy. >> I can see that. Especially when I'm getting Smash [ __ ] in my face. Huh? Don't react. >> New York doesn't let officers just arrest whoever called or whoever's loudest. In a domestic case, they have to identify the primary physical aggressor, weighing the injuries, any threats, and the history on both sides. That's why one deputy takes his version while the other checks her injuries in the room. >> When did that happen? earlier >> or just like 10 minutes ago, half an hour ago, >> I clean up the >> you guys lay down and start going to sleep and I come out just >> arguing about the water and I'm like, "What are you doing? Who are you talking to?" Calling the cops. >> She got psychosis addict. >> What kind of drugs does she do? >> Pills. that are prescribed to her or >> they're prescribed. So, it's all good. You know, they ain't going to get no trouble for it, but abuse is act like a So, you guys got into an argument about the vape and you tried to separate, go to bed, and then you came back out. She said that she was calling the cops and that's when she smashed the >> Yeah, pretty much lamp over here. And then in the meantime, while we were coming here, you were trying to clean up. >> You got the bed over in the other room, I was like, "Stay out of my room." >> We're about separate. We're starting to separate. >> Okay. >> But like I said, everything in this place is my [ __ ] >> She had like a truckload of Get the out. She already tried her family. You know what I'm saying? >> Tried to move her out of here. >> Yeah. I'm trying to >> Well, there's always a uh if you do split um >> I just don't like that. I'm not trying to do >> you can go through you're trying to do it like your own way like just civily between the two of you. >> Her family's sick of her. She owes money. My family, her family. >> Is her family around here or no? >> Yeah. Other side of like my family like I grew up here. Would her family take her in? Like if she like if you guys split or whatever, would they take her in or >> she already said you got no place to go? >> And then the next day it's like nothing happened. It's not my fault. >> Not your fault for what? Like if stuff like this happens or like you're talking about >> it's likeing having a bugout. >> I'm sorry. Sorry to hear that. That's terrible. >> A bunch of I got to [ __ ] pull out but I got to go to work tomorrow. >> Good if I take off. >> Yeah. >> All right. >> Is she just she's just chatting with her? >> Yeah. She's going to bring out her car. >> Okay. H she's going to talk with your girlfriend. What's her first name? She's going to bring Amanda out out here and speak with her at her car. I mean, if you want to stay warmer, I can >> so I can crack like put the window. >> Well, I don't know what we're doing. My partner's talking to her. Figure out what she's got going on and I'll tell her about what we found. >> What's going to end up happening? I already know. Well, what would have happened that would make us take you to jail? >> I really don't give a I'm saying I will go to jail to make the situation change. >> Well, that's >> I got to go to work tomorrow. Then I work three 12-hour days. Guess what? I'll be gone. I don't care. She can move herit out. >> What do you do for work? >> One of my good friends is one of the like head guys over there. He seems to enjoy his job. >> Grandfather was a conservation officer. >> Oh yeah, that's what I wanted to do prior to this. >> Just got busted not too long ago for shooting a deer without licenses. >> Oh god, that's awful. You aren't going to be able to hunt for a while now. though. >> Yeah, those guys uh they don't mess they don't mess around with that stuff. They >> typically take uh >> I need some food though. >> Take that stuff. >> You probably get pretty good. >> We get paid pretty good. You say >> I would say so. >> It's not bad. I guess >> I got a good fridge. No, >> my fridge. >> I have a fat sheet and all >> my uh fridge is actually pretty empty to talk to to be honest with you. >> That's the way it is. >> My fridge is actually I did what I did. >> Oh, I can I can understand. It's not uh >> Yeah. >> It's not the greatest times to be buying stuff left and right. No, guess what? They took all the meat and everything, too. So, that's cool. Oh, a lot of [ __ ] shaving up meat and getting everything really nice and perfect. I don't know if you ever done it before. I'm sure you have, but >> Skin and stuff like that. Yeah, you of course. >> Well, take it. You know, that's cool. And it really makes me appreciate everything. It's like you can't live with No, I got you. It's >> out of here. >> Got a lot of things, but I'm sick of it. >> Not the way I want to live anymore. >> I'm better off in prison, you know. >> Better probably better off in prison. >> No. >> Yeah. We'll see. That's what I'll do. All right. >> Their stories now contradict each other on the one thing that matters. And that's exactly where physical evidence takes over. The marks deputies can or can't find on each of them end up carrying more weight than anything either side says. >> Oh boy, you guys are like jam-packed in here. >> Oh yeah. >> Thank you for how much money you take. >> Of course. Well, I need to appear in court in the morning or >> No, it's just automatically done. >> Yeah. >> Okay. >> Hey, are >> you just getting a statement and stuff? >> Yeah. >> Yeah. It's going to be um if I can get the statement from her, it'll be criminal obstruction and harassment and then she wants protection. >> Okay. >> Okay. All right. Um, >> so just hang talk to him until you have that done. >> Yeah, that's fine. >> He's done this someone else before. >> Okay. >> I should have known. Should have been a red flag. [snorts] And like just two months ago, the cops served a warrant here to confiscate a gun that he had illegally. >> Mhm. [snorts] You guys aren't married, right? >> No. >> 3 years. Show us quitting that. >> Do you guys have a child in common? >> No. >> 55. >> Is he on probation parole? >> No. >> No. >> No. >> He says he always likes to just serve his time so that he doesn't end up on probation or parole. >> Okay. which put them over my nose to um honestly [snorts] I know how quickly you can lose consciousness and I've talked to safe harbors before and they explain to you the dangers of being choked or being smothered and what it can do to you and it is very scary. [snorts] >> Are you in pain at all? Yeah, my mouth hurts pretty bad. I'm hoping that maybe just some chapstick or Vaseline will help. >> Do you want to get it checked out by anybody? >> No. >> Your pictures are enough, right? >> Yeah. >> Okay. >> He's saying that she smashed a lamp over his head like that. Okay. >> Okay. She said that he she threw him into the >> What's that? >> She said that he uh threw her into the lamp or like into the bedside table that knocked over the lamp. >> Okay. >> Does he have any marks on his head or anything like that? >> I didn't see any. >> Okay. >> I'll check again. >> Uh he wanted his rights read to him, so I read him his rights and he said he doesn't want to talk anymore. Okay, that's fine. >> I don't I'm not going to get anymore. But I would change uh it so we have one custody and not detained anymore. >> Yeah. >> What do you mean? >> Huh? >> What do you mean? >> Like have her sign off on the statement cuz we can finish [music] that off. >> Yeah. Well, I want to give her the paper. >> Yeah. Yeah. Oh, like the handwritten off. >> Mhm. >> Oh, okay. >> Oh, you want me to like write it out? >> No. Oh, you'll type it out on this thing. But >> you need me to grab you a form? >> Um, no. I'm going to have her type it on this. I just want to be able to give her this so she can take it with her. >> Okay. >> I'm almost done with that. >> I'm almost done with that. >> Okay. Yeah, no worries. I was just trying to grab paperwork for you. >> Miranda only comes into play when someone in custody is being questioned, which is why deputies weren't required to read it the second the cuffs went on. The moment he says he's [music] finished talking though, they have to stop trying to get answers out of him. >> Was there any witnesses? >> No. >> Okay. Um, so you said that you went into the bedroom to get some of your stuff? >> Yep. Um he just like kind of once I reached the edge of the bed, he grabbed me and kind of threw me into the bedside table area um kind of between the bedside table and the bed and that caused the whole bedside table to crash over. And >> I'm sorry. You said um once you got to the end of the bed, >> what happened? Sorry. >> He grabbed me. >> Okay. >> And he pulled me backwards. Actually, he pulled my hair, too. He pulled me backwards by my hair. And he like kind of pulled me backwards by my hair, bringing me back towards the middle of the bed and the bedside table. And that's when the bedside table fell over and all the stuff on it crashed. And I ran out of the room. I tried to get on my mattress and like cover my head with pillows [snorts] and um his hands are on my face. He put both hands over my mouth [snorts] and I couldn't breathe. And then once I was able to wiggle free a little bit, his hands kind of went inside my mouth and he like pulled like pulled my mouth kind of like open, you know. >> Mhm. >> He came at me again and was going to take my phone from me. He didn't actually get his hands on it. >> Okay. cuz they would like shove it underneath myself. >> Mhm. >> Um but he and his grandma just died like a couple weeks ago [snorts] and I feel really bad for him, but his drinking is so out of control. Like I think he's had like four fireballs tonight and a six-pack. Um, have you guys had any physical or verbal arguments like this in the past? >> Yes. >> Uh, what kind? >> Physical. Verbal. Um, there's probably some police reports out of Ontario County. Um, one time he broke a door down and choked me. And another time, uh, he assaulted me and then took my phone from me so I couldn't call 911. >> Okay. >> And I know they did reports both times. >> Did they arrest him at all? >> Um, no. They kind of left it up to me. >> Okay. And uh he said like the cop was like, "Well, look, I'm going to go out there and really make it like you know that you could have sent him to jail, but you didn't to hope to dissuade or dissuade him from continuing." Um and then there were a couple times when Penny police were out here. >> Okay. But as they were taking him out, he begged me not to say anything about what really happened. So I I couldn't say. Okay. >> Has the [snorts] physical violence increased in frequency or severity over the past 6 months? >> Yes. >> Okay. >> When he gets released, is he going to be able to come back? >> It all just depends. But you'll warn me, right, if that's the case, so I can sleep. [snorts] Um, I definitely would try to find somewhere to go. Okay. >> I just don't really have somewhere to go. >> You don't have like your sisters or anything. They've got their own things going on. [snorts] >> I'm sure they would definitely want to help you. >> I know. [snorts] >> Okay. So, this is where I'm going to have you write a statement. It might be really hard. Um, our system's all messed up. >> Okay. >> Um, >> so just write exactly what happened. >> Yep. exactly what happened, how he made you feel, and try to be as descriptive as [music] possible. Okay. >> Request for um order of protection. Like I don't have to come to the court. >> Nope. [music] So um they'll review it for you. Um and then it'll be up to the judge if he wants to issue an order of protection or not. >> Okay. >> And like what kind of order protection um they'll end up issuing. >> Okay. >> Um excuse me. because it could be either a a full stay away or it could be a refrain from where he could still be in the house but he just has to refrain from doing all those things to you. Um I can put it in a request of which one specifically you would like. Um doesn't mean that they would go for our request. Um, but I can say if you do um if you would rather have a um refrain from or stay away um I can ask them for that. Um but like I said, it doesn't matter. It they could tell me leave it up to them. Uh will they notify me or uh so you will also get like a piece of paper stating like what what it is. um if it ends up being a full stayaway, then he wouldn't obviously be able to come to the place of your residence. >> Okay. >> Um so that would be something that would have to get figured out cuz obviously he lives here too, >> right? >> Um but that's something that would just have to get, like I said, figured out. Um >> Yep. >> between between whoever. Okay. Um, but yeah, I thank you guys for coming so quickly. I wasn't sure if I was actually getting through to someone, but I couldn't call because he >> Yep. No, I get it. We would have >> Every time I picked up my phone, he came at me. So, >> yeah. Yeah, we uh we would have been here quicker. We were just uh we were on another call that was uh probably the furthest we could have been. >> Oh, that sucks. We got here fast. >> That's good. You think they had assistance from the PD? So, I don't have anything else from you. >> Um I don't believe so. I think I have all the information from you. >> Going to jail for the night like going to camp for like in the morning. Yes. >> Okay. >> Yeah, that's what's going to end up happening. Okay. >> Okay. And there's that for you. >> Oh, I get two copies. >> So, that's going to be the victim's rights and all the information on there. The first page is um like the report that we filled out with your um statement and everything. Okay. >> Okay. >> You should be all set. Okay. I I thank you so much. >> Yeah, no problem. >> All right. >> Have a good night. >> You, too. >> Thank you. >> The order of protection she's after can actually be put in place at the arraignment on just these charges before he's convicted of a thing. And once a judge signs it, breaking it becomes a fresh criminal charge all on its own. >> All right, Chris. Oh, we got you in the front. Look at you. Um, so we got a statement from her and all that. Um, so we are going to be taking you to the jail tonight. Um, well, you'll get arraigned in the morning. Okay. >> Yeah. >> All right. >> She's just got to pass that seat belt through. >> Yep. So, at least you're safe. >> Tell her that she's out of here. >> Okay. >> Probably tomorrow. >> Okay. >> I got to reach out. >> Get her [ __ ] out. >> Yeah. That house is my [ __ ] >> Yeah. No, I get it. >> So, what happens with my [ __ ] in this house? Do I have any like precedence on what what's up with my >> like what do you mean like tonight? >> Everything that's in that [ __ ] house is my >> Okay. >> Yeah. I mean that's Yeah. No, I get it. I mean she's even but >> Yeah. She's even said that only some of her stuff is in there. Like it's just she has leaving out of here. >> I told her it's best if she does leave, but I mean she's been staying here. So >> So I can come. Oh yeah. >> It just all depends on what happens tomorrow. >> I've been paying all the bills. >> Okay. So what? I go to jail because of what? What am I being locked up for? >> Uh so we got a statement from her which you'll be able to see in court tomorrow. Okay. >> So what I want to know what I'm getting locked up for. >> All right. So we got >> Is that stupid or what? >> No, it's not stupid. Hold on. It's Hold on. You're not fully seated in there. Do you want this under your arms? Okay. Um so it's going to be criminal obstruction of breathing and then harassment. and she does want an order of protection, but it's up to the judge if they issue that. Okay. So, it's all going to be when you get arraigned at CAP tomorrow. Okay. >> Like I said, I pay rent at this place. >> Mhm. >> She hasn't paid rent in likeing 5 months. >> Mhm. But she's been living here for more than 30 days, right? >> Yeah. >> Okay. >> But [ __ ] she ain't paying my house. >> No, I get it. >> All right. So that's just what that's >> is great. So I'm going to come home and my shit's going to be >> I'm hoping she doesn't mess with your stuff. >> You guys are good cops. >> That's it. Let's go. That's what I'm doing. >> Um once you go to the jail, they're going to ask we're going to have you take everything out of your pockets. Okay. >> Okay. That's great.
