on September 7th 2023 at approximately 4:15 p.m. officers responded to a restaurant in Florida following a dispute the female subject called 911 reporting that the valet hadn't provided a ticket for her vehicle and they couldn't locate it dispatch noted that the subject was slurring her words during the call and the subject identified her vehicle as a blue Range Rover the restaurant manager later contacted dispatch expressing concern that the female subject might be intoxicated and worried about her driving the manager mentioned that the subject was currently in her vehicle and the staff had offered to call an Uber for her subsequently a witness informed dispatch that the subject had nearly driven over the curb prompting staff to intervene and prevent her from driving the witness added that the subject must have had a second key as she entered a Range Rover and attempted to exit through the valet entrance you found your phone that's a very interesting item to carry around in your purse yep you're Miss yeah I don't think the restaurant want bring well I don't know what the restaurant wants but I know that I have that in my bag all right Miss kathen just talk to me real quick in N well I don't think you're in any position to be calling you over okay because you were driving a vehicle and it appears that you're under the influence that's our concern okay driving into the influence so that's our concern I drove well when you came out and you circled around and and they they took you out of the car the management from there to there you're going to charge me driving under the well you can actually be charged for not even driving for just sitting in the vehicle okay for sitting in the driver's seat okay so I want to do some roadside exercises with you all right if you're not under the influence we'll uh send you home all right are you kidding me no I'm actually very serious tell me that I did not drive that car I drove that car I drove it you did not drive it that Salon they still no they don't they do well I don't know so I went to get my car they said I don't know where your car is I gave them the ticket I had the money ready and I couldn't find my car so I I did not drive that car you're not going to accuse me well no they they said that you drove the car I did not dve car they saw you driving it after you walked out no is not what they said I so participate in standardized field sobriety exercises sure that actually makes it way easier what what conditions with your arm that you're wearing that I I have a broken shoulder you have a broken with your eyes besides glasses no okay are you able to walk a straight line and can you balance on one foot yeah so your only injury is your right shoulder yeah okay no other injuries with your legs you're not going to dispel my concern meaning if you don't do these exercises I'm not just going to walk away and say well she didn't do the exercises so I guess that she's probably not under the influence next you will force me to make an arrest based on the totality of the circumstances as I know them which means I will arrest you based on everything I know to this point okay everything I'm seeing smelling hearing everything Witnesses are telling me okay that's what the arrest will be based on and I will be forced to make it and last it'll be used against you in court which is pretty self-explanatory so do you understand understand everything I just explained to you not really okay what don't you understand that I'm going to be arrested correct for driving Under the Influence yes
