in June of 2022 Nassau County sheriff's deputies in Florida responded to a call where a man's brother wouldn't leave his house as always full police report is down in the description and I'll go over the outcome of the case at the end of the video so what's going on okay and said that he would uh give him a ride to Baldwin took 10 steps out collapsed passed out whatever so they called it the rescue somebody so except on rescues like you want to go to the hospital he said no I said all right we're going to Baker Act you we're gonna they have to keep you 72 hours and then I don't know if he walked out he told my mom that they released him and he got a ride from downtown Baptist back out here because he says he has nowhere else to go okay I mean he hasn't lived here in like 14 months he's homeless he he's been living in Jacksonville and I guess this is his only thing that he thinks he can come back out here right and he had a trespass yesterday or last night or whenever it was yesterday around four yeah okay and then is that still active or has she since dropped that well she wrote down the wrong court date because he was served here you know in Junction papers and the next time we went to court it was the first time we've seen the judge and the judge like well it's not in our system that he's been served and he should have been you know I got everybody's office he said yeah it was this paper okay he wouldn't do nothing with it sir so how about this if I walk in with you how about we walk past him and you just give me the paperwork and be able to handle that yeah yeah you don't have to say nothing nothing like that I just wanna now that I don't believe you guys want to make sure and then I can go from there I'm guessing that red bag or whatever color brown is his oh that's my dad okay he's not feeling too well okay they're they're visiting I think he's supposed to help him gain some weight I gotcha all right yeah like I'll walk in there with you just uh so we can kind of keep everything calm and then you just show me the paperwork and then we'll go from there I got you so I said I'll walk in there with you maybe maybe a little present so kind of calm me down some might get it all right man you stand up for me yeah you got a trespass for me a lot back here you gonna stand up for me Robbie man stand up for me going to put your hands behind your back put your hands behind your back like you're praying [Music] yeah if he's got some shoes if you want to help them or if you want to step in them or am I gonna have to drag you out of here if you're gonna sit like that huh okay I'm at the Dragon I got it out of the car whenever you came back that's fine I could absolutely do that such as badass Robbie I'm not I want to be such a badass man stay away from my house you know you're such a badass dude you I've done nothing dude I'll try to come home this ain't your home you don't live here anymore you're an addict you have a problem I'm not on the truck man we're not doing this no we're not doing this that's fine I'll drag you right down there looks like this oh God yeah cooperate with me I cooperated but am I gonna sit here and deal with this come on get up we'll get them in a minute man turn around hold on we're gonna put your pants up okay you need to cooperate with us all right yes sir let's do this is the easy way I'll come back for the shoes man I want you to stay back here all right but uh yeah I was letting mom put the shoes on for him then he wants to start yelling and screaming that brother so that's when you pull up when I was dragging them out like we're not playing this game I don't want to walk I mean we got no joy you need any information from them I think brother's in there I think I've done a signal nine of a signal Zero from him so he should be in there and he's in there already so Brothers Robert Simmons all right cool we're gonna roll them you already have a narrative typed up okay I just got to change names and cool all right I'll let them know we're wrong all right all right all right man sir we're gonna go ahead and uh take him over to jail okay he's still wearing the scrubs from the hospital whenever the officer trespassed him yesterday he offered him to take him a ride but he wanted to walk he got out the driveway 10 steps and fell down he's homeless he's weak I'm sure he had dehydration okay well they're going to take care of me we got nurses and stuff like that over there so the thing I'm concerned with is the paramedics Baker acted they took it they said we're gonna bake her he's been Baker Act and he just walked up well we don't know I mean he he may have been released but the way he's what he's dressed it's possible but we'll figure all that yeah we'll figure all that out I mean if they Baker active and they should have been you know I don't know I mean technically the only people can Baker Act somebody is a a judge a doctor or law enforcement the paramedics can't do it officer was here the officer did it then okay and then he probably did who was it Andrews okay his last name was John oh Johnson okay okay well that's fine no If he if he did corrected him took him down there he may have walked away but we'll figure it out but he's in good hands now we'll we'll get him helping Eve you told me before that he does so much heroin that he cocaine or crack is just like smoking a cigarette now it does nothing for him okay and he uh took some money from her two weeks ago okay and he came yesterday saying well I detoxed that's why I got the hospital being on I detoxed I'm done I'm over it let me come back from the state okay detox from that heavy of usage in five to six days no you can't I mean that's like a six-month program at a place that you have to stay there yeah well I mean we we're taking over jail and came with process and we'll give them the help he needs over there yes sir they're using good hands now so yeah no worries thank you you all need anything else y'all give us a call okay yes sir have a good day I'm sorry trespassing state of Florida well that's all that's up to a judge I can't make the determination on that so I Googled it and it said 60 but if he's caught inside it could be a year yeah I mean it's probably it's all to the judge it's a misdemeanor charge it can be up to a year unless it would be better for him to be away from the streets I understand but that's above our pay grade that's you know people make a big money make those calls for so but uh just feel feel relieved that you know he's going to a better place right now he'll get the help he needs okay yep oh yeah he's with the medical attention he needs and hopefully this will get him off streets for a while so yeah okay thank you thank you yeah you got it take care now all right Richard was charged with two misdemeanor counts one for trespassing and an occupied structure and one for resisting officers without violence he was denied bail and about a month later pled no contest he was found guilty of both charges and sentenced to one month and two days of jail time and was given credit for his time
