The Jeep had sustained heavy front 10 damage on the passenger side, while the Chevy Traverse had sustained severe backend damage on the driver's side. [Music] Yep. >> Um, so she lives on Mhm. >> She made the turn. This car was parked unoccupied and she told me she was on her phone and just like sideswiped it. Um gave an order of alcohol when I uh approached the vehicle. She admitted to me that she had a glass of wine. Um so you know I don't have HGN. >> Okay. So, let's just get down. See this? >> Okay, sounds good. Do you want me to do that part of it and you >> take over the rest? >> All right. >> Yeah, man. What do you think? >> Yeah. Heat. Heat. All right. No problem. Is this Whose car is this yours or I just the Chevy tracks? It's the 24. >> Mhm. It's a really nice car. I mean, it's it's like fairly I mean, as far as new cars go, inexpensive. It was less than 30 grand. It's got like It's fully loaded. It's got all the the bells and whistles. It's not like a >> It's a small I guess like a mini SUV. I don't even know. >> Yeah. >> Like a hatchback almost, but I really like really nice. >> Well, it drove really nice. >> Well, yeah. I'm sure the replacement will be really nice. >> Yeah. Just got to figure out what tomorrow. Mhm. Uh, so we got the on the way. >> Okay. >> Yeah, sometimes they can take so here. So the actual number. >> Okay. uh pick it up and get it online addressed. Just uh call your insurance company, tell them what happened. >> Yeah. You got everything in the uh the car? >> Yeah. Okay. >> Do you need keys to to >> uh generally it makes it easier for them. Yeah. Heat. Heat. [Music] Heat. Heat. Yeah, [Music] it's a good one. Yeah. >> You're not injured or anything, right? >> No, I'm fine. I'm just I feel bad. It's my neighbor. >> Sini told the officers that she was headed to the woman's club and that she had just left her house nearby. She admitted that she was looking at her phone and texting at the moment she struck the Chvy Traverse. Officer Dorfman asked her if she had anything to drink and she admitted to having a glass of wine earlier that evening. Based on his suspicion of impairment, Officer Dorfman called for Sergeant Dean McCroll to come on scene and assist with field sobriety exercises. >> Okay. >> Yes. Can we get a talk over here? >> Okay. >> So glad you're uninjured. The concern that we have right now is the odor of alcoholic beverage from inside. >> Okay. >> Okay. Um I mean you told me it's one glass of wine. >> Okay. >> Sometimes people say one glass. It's really more than one glass or the glass may be, you know, filled to the brim. So, >> what do you need for me to do? >> Okay. >> So, we'll explain. Um, my sergeant right here, he's going to check your eyes. >> Okay. >> And then I'm going to demonstrate a couple tests. >> Sergeant LC Carol started with the horizontal gaze nagmus HGN test and he observed indicators of impairment. The second exercise was the walk and turn test and it was administered by officer Dorfman. During the walk and turn test, Sini failed to touch heel to toe on each step while displaying the lack of balance. The third exercise was the one leg stand test and Seni failed to raise her foot in the proper fashion and put her foot down before the test was complete. The final exercise was the modified robert balance test and it was administered by Sergeant McCarol. She did not perform this test satisfactorily. just to make sure that you're uh you're okay. >> Okay. >> All right. You uh you said you don't have you're not injured. >> I'm not injured. >> You have any type of medical >> No. >> issues going on of any kind? No. Nothing. Okay. >> All right. Ma'am, if you could. All right. You see my finger right here? >> What I'm going to have you do, if you could just take your hands out of your pockets, put them down at your sides. I want you to look at my tip of my finger right here >> and don't move your head. Just look at my finger right here with your eyes. Your your eyes only. >> Okay. All >> right. And just follow it as I as I move back and forth. Right. [Music] Okay. Well, I'm going to go up now, right? Okay. Do you take any medications? >> No. >> Nothing. >> Did you take anything uh >> nothing? >> Not prescribed to you or anything like that? >> No. Okay. I went the rest. >> Okay. All right. So, miss, um I'm going to have you do two tests. Um the first one is called the blood control test. I know >> we're on Claremont. We're >> neighborhood >> doing some testing. >> It's not the ideal situation. >> The issue is >> is that why what >> we respond to a car accident especially, you know, single car. >> Yes, it's a motor vehicle accident. So, we need a tow regardless for both cars. >> Then depending on the results of our uh >> testing intoxicated, then it's going to go very smooth. So just let us do our job and then the whole thing will be over hopefully. Uh so >> okay. >> Okay. All right. So Jesus Christ if if you would prefer we can move over there or something like that. Okay. Just get it over with. Okay. So I'm going to explain the test. I'm going to demonstrate it and then I'm going to ask you to do it. Okay. Um so you can stand. What you're going to do is imagine uh imaginary line on the ground right here. Um you're going to plant your right foot on the ground, left foot behind your right foot, hands down at your side. If you can just um get in that position, please. Okay, I'll I'll demonstrate it this this direction so you can see what I'm doing. Okay. your right foot left. Okay. >> Okay. So, you're going to have your hands down at your sides. Imagine a straight line on the roadway right here. With your hands down at your sides, and don't start until I tell you to do so, okay? At this point, I'm just explaining. Hands down at your sides, you're going to take nine heel to toe steps, counting out loud, looking down at your feet in this manner. 1 2 3 4 and so on. When you get to your ninth step, you're going to plant your front foot on the ground. You're going to make a number of small rotations going back in the direction in which you just came. And you're going to do nine steps going in the other direction. Same thing. Hands down at your sides, looking down in your feet, counting out loud. 1 2 3 4 5 and so on until you get to the ninth step. When you get to the ninth step, the test will be complete. You ready to begin? [Music] Okay, you may begin. 3 4 5 6 8 9 [Music] 4 [Music] Okay, you're good. All right, so we're going to do one one more test. Okay, this test is called the one leg stand. Same thing. I'm going to demonstrate it. I'm going to explain it and then I'm going to ask you to do it. So, what you're going to do is you're going to start in this position, hands down at your side, feet together. Okay? What you're going to do is you're going to raise one leg off the ground. Either leg, your left or the right, whatever you feel more comfortable with. What you're going to do is you're going to raise it approximately 6 in off the ground, keeping your toe down. While you're doing that, you're going to look down at your toe and you're going to count out loud in this manner. 1 2 100 3 100 4 100 Keeping your foot approximately 6 6 in off the ground, counting out loud the entire time. I'll tell you when to stop. Just keep counting. Okay, just give me one second. Just got to get a timer. Okay. Whenever you're ready, you may begin. >> 1 100 1 2 1 100 3 100 4 100 5 100 6 100 7 100 8 100 9 100 10 100 11 100 12 100 13 100 Okay. >> Should I start over? >> Yeah, just start over, please. >> Oh gosh. One 100 1,00 2 100 3 100 4 100 5 100 6 100 7 100 8 100 9 100 11 100 12 100 13 100 14 100 16 100 17 100 18 100 1900 20 >> Okay, you can stop. Thank you. Oh, let me head back. I'll do that one. If you could just take one one step forward, then put your feet together, hands at your sides. Just this last test if you could, I want you to put put your head back. What? Not what I when I tell you to. Sorry, let me specify. When I tell you to, >> okay, >> you're going to tilt your head back. >> While your head's back, you're going to close your eyes. >> Okay? >> So, your head's going to be back. Your eyes are going to be closed like you're looking up at the sky. You're going to estimate to yourself the passage of 30 seconds. >> Okay? >> So, don't count to count to 30. You're just going to estimate 30 seconds. When you feel 30 seconds has passed, just tilt your head back forward and then open your eyes and you can say stop. You can say done. You can just some kind of indicator that that is your your internal clock. You've reached your 30 seconds. >> Got it? >> All right. While you do it, you're going to keep your feet together and your hands at your sides. >> Okay. >> All right. You understand all that? >> Yep. >> All right. You uh we'll use your >> Do it now. We'll tell you in a second. >> Whenever you're Whenever you're ready, just 34 Oh, we're getting some indicator that So, what's what's the real number? While I was getting ready, I had a glass of wine. That's all it is. What? What can I do to like >> Well, I mean that's why we just did those tests. >> Which one was not like passing? >> So, on from my observations and officer Dorfman's observations here, uh the eye test, >> you gave uh all the indicators that there's uh alcohol in your system. uh your walk and turn, you had points in it that weren't you weren't weren't done satisfactory. Um your when you estimated your time that was not done satisfactory and your >> your foot raise was unsatisfactory. Um is there anything else that you've ingested or put into your body? >> Cuz another thing that I that I've noticed >> when I was checking your eyes is your pupils are very constricted. And since it's it's it's odd because it's nighttime right now, you would think it would be the opposite. Your pupils are t typically larger to take in. Based on the motor vehicle crash, her admission to consuming alcohol, and her inability to satisfactorily complete the field sobriety exercises, officer Dorfman placed Seni under arrest for driving under the influence. After she was placed under arrest, her vehicle was impounded for a 12-hour hold. According to John's law, officer Dorfman transported Seini to the Westwood Police Department for further processing. >> Okay. More like >> But for the time, like I don't want to do too less of a time because then you think I'm counting too fast. Like how can I >> Where we're at right now is what I believe that you're impaired right now. >> Okay. I think you're impaired due to uh alcohol, okay? >> Or any other substances you may have ingested. >> Okay. >> So, I think at this time uh we're going to place you under arrest for driving while intoxicated. And so, if you could if you could just place your hands behind your back. >> Just going to take your And ma'am, just so you're aware of your rights, you do have the right to remain silent. You have the right to have uh an attorney with you during any questioning and you had to stop answering uh any questions of ours at any time. You understand that? >> Mhm. >> Okay. Can you just get my purse and my wallet? >> Well, you can get your purse and your wallet. Yes. Uh, is there any other personal effects or anything that you need out of your car? >> No. >> Okay. Do you have a cell phone? >> In my pocket. >> In your in your pocket. Okay. Which pocket is that? Right here. >> Mhm. >> Okay. >> Okay. Um, which pocket is it? >> It's this one here. >> You got nothing else on you? Nope. >> Okay. All right. I'm going to place you in the back of my vehicle. Okay. Inside that vehicle being audio record. Okay, just let me grab the uh Thank you. [Music] Thank you. I'll be transporting my location 687. [Music] Heat. Heat. [Music] [Music] Heat. Heat. Heat. Heat. Heat. Heat. Heat. [Music] Heat. Am I taking the laser to get out of this? >> Yeah, that's what that's what we came back to headquarters for. Just watch your step. All right. Start in here, please. Close. [Music] at police headquarters. Senior was read the standard statement for motor vehicle operators and agreed to submit breath samples. Open the side door. Okay, just watch your step. All right. So, we're going to go into the right. Okay. Okay. Just uh do me a favor. Turn around face, please. You I'm going to take the handcuffs off. Okay. Just uh if you can just uh turn your hands towards me. Yep. Yep. Just like that. Thank you. Can I your other hand, please? Just Okay. All right. You can take a seat. Okay. [Music] Okay. Um, I have to place you in the room next door for a minute. I got to get some paperwork and then take you out and we'll go from there. Okay. Just do me a favor. Um, you don't have a belt on, do you? >> No. >> Okay. Your jacket, um, your cell phone's going to have to go in here in the property bin. >> You have to get out. >> What's up? >> You took it off. >> Okay. You don't have anything else on you? >> Okay. Can you just take the jacket off, please? Okay. You have any other jewelry on you? >> Bracelets. >> Okay. Can you take those off and >> put them in the uh locker, please? cuz my shirt. >> Okay. Do you have a neck? Do you have a necklace on? >> Yeah. >> Okay. Can you take that off, please? >> And my ring? >> Yes, please. >> Okay. And then what's the next steps? >> So I have to get some paperwork from another part of the police department. I'm going to grab that, come back. I'm going to start on the paperwork. Then we can do the alco test machine and try to get you out of here as quickly as possible. >> And if the alcohol machine is >> Let's just deal with it one step at a time. Okay. Thank you. He's right here. Heat. [Music] Heat. [Music] 19. Last one on two. [Applause] Okay. So, you asked about the uh alka test machine, the breathalyzer. Okay. So, before we do that, we have to do a little bit of paperwork. I have to read this to you. Okay. Um Okay. You've been arrested for driving while intoxicated. NJSA 3950. The law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. A record of the taking of breath samples, including the test results, will be made upon your request. A copy of that record will be made available to you. After you provide samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you'll be issued a separate summon for the refusal. The court may find you guilty of both refusal and driving while intoxicated. If a court finds you guilty of the refusal, you will be subject to various penalties, including license revocation up to 20 years, a fine of up to $2,000, installation of an ignition interlock, and referral to an intoxicated driver resource center. These penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty. You have no legal right to an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing. Even if you agree to take the test, but then you do not follow my instructions, do not perform the test, or do not provide sufficient breath samples, I will charge you with refusal to submit to breath testing. I repeat, the law requires you to submit samples of your breath for testing. Will you submit to the samples of your breath? >> Yes. >> Okay. >> And what happens if they are not? Well, let's let's do this one step at a time. Okay. So, provided yes, let me get everything in place and then we'll move on to the aqua test machine. Okay. Her alco test results indicated a back level of 0.17% which was more than double the legal limit of 0.08%. After she was processed, she was released to her neighbor after she signed the potential shady warning form on Seni's behalf. Sini was issued the following citations. Operating under the influence, careless driving, use of handheld device, and failure to maintain lane.
