Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal as a refusal to submit the breast testing. If you agree to take the test but do not follow my instructions, do not properly perform the test, or do not provide sufficient breath samples, I will charge you with a refusal to submit breath testing. I repeat, the law requires you to submit samples of your breath for testing. So, will you submit samples of your breath? >> Mhm. >> I need you to say yes or no. >> Yes, sir. >> Yes. Okay. All right. So, now I got to read you this. This is your Miranda warning. Okay. Uh, you have the right to remain silent and refuse answering questions. Anything you say can and may be used against you in a court of law. You have the right to consult with an attorney at any time or have him or her present before and during questioning. If you cannot afford an attorney, one will be provided if you so desire prior to any questioning. A decision to wait these rights is not final and you may withdraw your waiver whenever you wish, either before or during questioning. Uh, do you understand? Okay. So, I'm just going to ask you questions about, you know, what happened right there. All right. So, you going to answer my questions? Okay. So, and again, I I get that you're having a really horrible day. Okay. I know that, you know, an accident happened. It happens. Okay. All I need right now is just can you just tell me what happened, where where you were located with the vehicle which led to uh the accident that took place on West Bank. >> Honestly, you're really not going to believe me. It's going to be like a [ __ ] he said, she said [ __ ] >> Okay. Well, most accidents are, so that's all right. >> No, really, it is. Um, I was with my friend and she said, "Why don't you just go?" And I I know I was stupid and I This is really one of those moments where it's like, "You were [ __ ] stupid. You were [ __ ] stupid. That's all there is to it. You were [ __ ] stupid and I'm going to eat it." Well, look, I >> I'll just eat it. I >> Everybody makes mistakes, okay? I'm glad >> because like I know it's like I shouldn't listen to the person in the passenger seat, but it's like when you have that person barking down your neck, it's like go go go go go. And then it's like once you go, it's like [ __ ] >> I get it. >> I'm sorry. I really I don't I It's one of those things where I really just like I don't know what to do. It was my fault, but also it was my fault. I shouldn't have gone. It was my fault. >> Where where were you coming from? I know you were coming from your friend's funeral. Is that where you were drinking at the funeral home or was that like a bar? It was a rank or something. >> I took two shots there. >> Where where was there though? At >> the funeral home. >> Okay. And that was really all I had. And then Bella said that she was going to drive. And then she didn't drive. And I mean like it wasn't like I was like, "Oh my god, I'm so drunk. I can't drive." Yeah. Like I could drive. >> Mhm. >> Okay. So it was just two shots there. Did you have anything to drink on the way home? Anywhere else? >> Oh, my father. No. I was going to stop by my mom's, have a few French fries, have a maybe a couple tots. Okay. >> Have like a few nuggets, something else >> at your mom's house. >> Yeah, my mom is on town. >> Okay. Um, so where where is the funeral home at? >> It's Woods funeral home. >> Woods in Manahawk or >> No, no, no. Little life. >> Oh, yeah. Yeah. Okay. So, >> yes. That right? >> Yeah. Um, so >> do you feel I'm sorry. Do you feel bad yet? I'm [ __ ] freezing. >> A blanket. >> It's okay if you don't. I really don't. >> I do. >> You're I'm just really freaking >> I do have a blanket for you. >> Thank you. Oh my god. >> But I need you. I know my sergeant got a little bit annoyed because you guys you weren't really answering my questions. I'll give you this blanket, but you got to stay with me the rest of the time. Okay. >> Have to get you in trouble. I really don't want to get you in trouble. >> It's all right. I don't want you to sit there and be cold. So, here's a blanket. You can warm up. Just in return, I just need you to stay stay with me. >> What questions do you need me to answer? >> So, right now, like I said, I'm just we just have to wait a few minutes until I can do the um uh the breath test. So, I just want to know exactly what happened. So, you were drinking at Woods Funeral Home. What? So, like I obviously have to do an accident report for what happened and I know you said like, "Look, the accident is going to be he said, she said." Which is fine. I need your account of what happened regarding that accident anyway. So, I know you're not from Barnett. I know you're not super familiar with the area. I know you're confused about which road you were on. Um, so the road where the accident occurred, that was West Bay A. Okay. So, can you tell me where you were coming from? Like, were you on the Parkway? Were you on West Bay? Do you do you know where you were at? >> I'm sorry. It doesn't. >> I'm sorry. I'm not really good with roads. >> That's okay. Well, >> I haven't lived over here in a long time. >> Okay. >> It's been like four years. I really don't remember. Um, >> so I'll I'll ask you. I'll try to make it easy as possible. Were you on the Parkway? >> No. >> No, you were on West B. Okay. So, you were coming from Woods Funeral Home down in Tucker >> and you made your way to West Bay. So, did you come up Route 9? >> Okay. So, then you probably made a left onto West Bay at the light. >> Um, I'm guessing and we're going west. So, do you know were you going like towards the Waw Wa or >> I would have gone straight. >> So, you were going straight >> from from which side? >> I would have gone straight. There was no way I was going left. >> Okay. All right. I I'm gonna have to um talk to the other driver, see exactly because I'm just having having trouble. I know like you said, you don't really know the roads that well, but it doesn't sound like you know. >> I really don't know the roads that well, but I would have gone up if I was at Woods, I would have gone up nine. >> Right. So then you were on >> that means I would have passed Southern. >> Correct. All right. So you know where Southern is, >> right? Right. >> All right. So, you came >> to Southern. >> You went to Southern? >> Yes, >> I went to Southern. >> Me, too. >> Look at that. I think I'm a little older than you, though. >> Yeah. No, definitely. >> Yeah. Do I look that older? Thank you. >> So, anyways. Never. >> Yeah. Right. So, you're on West Bay A. So, you were going So, you were going west on West Bay A. >> Yeah. >> Okay. Um, did you go through the intersection that parkway light? >> Parkway light. What? So that that little overpass where it goes over top of the parkway. >> No. >> Okay. So you I mean look, you can be honest with me like do do you remember the accident occurring? Do you remember if you were turning or anything like that? Like literally anything that you remember is helpful. I just have to put it into a report. I know I appreciate you trying your best for me. Okay. I know you're being compliant and cooperative. >> Shopping clos. >> You were going into the shopping closet where the acme >> Okay. prior to the the accident happening. >> Okay. So, were you turning right into the acme? Returning left into the Acme? Do you remember? >> I'm sorry. I'm dyslexic. Don't >> That's okay. >> Don't make fun of me. >> That's all right. I'm not making fun of you. >> I think left. >> Okay. >> I don't remember. I'm sorry. I'm >> That's all right. >> Do not make fun of me. >> I'm not making fun of you. I just need your your best recollection of what happened. >> No, I seriously I do not recall. I was not paying attention. >> Okay. >> I just wanted to go home at my mom's at this point. >> Yeah. >> I don't remember. I'm sorry. This point was my mom. >> Okay. Where does mom live? >> New Greta. >> New Greta. Okay. >> Like it's like New Greta Little somewhere in there. >> I got you. >> I don't know what it's called. I don't know what it what it's considered. >> Yeah. Look, I'm going to talk to another officer. See if I can get a better understanding of how the accident happened. No, that's all right. I I appreciate you trying. I'm going to see if I can grab some more information when I know of what it >> Oh, God. areas. Oh, God. >> That's okay. Look, it's not it's not a big deal. I just wanted to your best attempt at uh tell me what happened. I know you did. It's okay. >> I'm not used to this. All right, Tori, just sit tight for me. I'm going to be right back with you. Okay. >> You want to go to jail? >> No, no, no. You're not going to jail. Okay. Look, Tori. I'm sure >> I'm positive you're going to go home with your mom tonight. Okay? I'm 100% positive. I'm not lying. I promise I'm not lying to you. You're going home with your mom tonight. You're just going to be with us for a few more minutes. Okay. All right. So, just some time for me. All right. >> Okay. Okay. >> This is a really stupid question. >> What's up? Am I getting? >> Yes. So that's what you're here for. >> Does that mean they got a black in the car? >> So you're hanging. Have you ever been charged with a DWI? No. So like you're you're going to have day in court. They're going to explain the penalties and everything. Uh I don't know exactly how it goes. They may revoke your driver's license for >> what? >> For a couple of months. It's your first >> It's your first offense. >> So, look, you're going to have to talk to a court. It's nothing to get upset about right now, okay? It is what it is. >> But you'll have a day in court, okay? They'll they'll explain what the penalties are, okay? No. >> So I have to What do I have to do >> for right now? All we have to do just in a 15 minutes we have to do breath samples. Okay. Um it's kind of the end of it. All right. I have to give you some paperwork and everything, but you'll be going home with mom tonight. All right. And you get a you get a court date in the future. It's about it. Okay. It's not a felony in the state of New Jersey. So you're not going to jail, nothing like that. It's just the uh the DWI. Okay. >> All right. So you just got to >> What does that mean? >> What do you mean? Like what was the what does that do you know what that entails like? >> So >> it's okay if you don't like I I >> so when it goes >> I'm not expecting like a whole spiel from you everything like >> no typically from here like like I said you'll get you'll get your summones and everything. You'll be you'll have to go to court for you know because you're being charged with a DWI. Uh a judge is going to >> you know sentence you to to whatever it is. There's no jail time or anything like that, but it could potent No, but it could potentially It's No, it's no jail time for your first offense, right? You said this is the first time this happened. Okay. Yeah, there's no jail time or anything. Um, but >> it may, like I said, nothing to get upset about right now. It's something to deal with in the future. It may entail you losing your license for a couple months. Uh, it may be one of those things that they put in your car that you have to blow into in order to get the >> So, look, >> no, please. I swear I really don't drive under the influence. I really don't. I really don't. >> But look, it's it's nothing that you need to worry about right now, okay? For for right now. Just >> I really don't like >> So, you just got to hang tight for a little bit. We're going to get you out of here as soon as we can and we're going to send you home with mom. All right. >> You're >> okay. >> All right. You're going home with mom tonight, so there's nothing to worry about. >> Okay. >> All right. So, can I lay down until mom gets here, please? >> Yeah. Can you do me a favor, though? I need I need you to stay awake. I know you're tired if you want to lay down. >> I've been up since 4:00 a.m. >> I know. I'm going to get you out of here as soon as I can, but like cuz I'm going to have some more questions for you. You're killing me. Okay. >> All right. I'm going to need you to >> No, not not right now. I just need you I just need you to be awake [laughter] when I when I tell you that I have a question for you. Okay, that's all. >> All right. Wait. Can I shut my eyes until then? >> You could shut your eyes, but if I But look, if I knock on the if I knock on the door, >> you can get mean with me. >> Okay. >> You can get mean with me.
