the description to support our work directly and as always enjoy the video on August 16 2022 officers were dispatched to Houston Texas in response to a domestic disturbance upon arrival officers met with the complainant who stated that the defendant is her biological son and they live in the same household the complainant reported that a verbal altercation occurred between her and the defendant in their household during which the defendant became irate and physically assaulted her by pushing her with both hands causing her to fall to the floor on her back while lying on the floor the defendant sat on top of her and attempted to strangle her by reaching towards her neck and face with both hands she was able to pull and forcefully slide away from the defendant's grasp preventing him from successfully strangling her however the defendant continued to grasp at her neck causing multiple scratches on her face in an attempt to stop the defendant from strangling her she bit the defendant's right thumb allowing her to break free and call the police upon inspection officers observed multiple visible scratch marks with fresh blood and bruising on the complainant's right cheek and lower neck the complainant reported feeling pain pain after the assault occurred and positively identified the defendant as her biological son who physically assaulted her causing bodily injury and pain the responding officer observed visible wounds on the complainant's right cheek and to the right side of her neck she was fighting with me a song with with the dogs man for the dog just for said uh they argue about the dogs she got in between she uh they say where I'm about the dogs then he uh grabbed and throw on the ground got on top of her and was trying to trigger they didn't choke his breath and scratched her up she said she didn't feel pain at any point now that it's burning because I'm assuming through the sweat is fine yeah so that isn't burned but she didn't feel any pain okay uh she says she doesn't want her present George doesn't want him to go to jail she wants him to get restrictions does she have any other injuries how did he get his swept his finger yeah foreign I understand oh [Music] then he got on top with two hands and then tried to choke her trying to choke but see if she came up scratched her neck and then when his hand got close to her mouth she bit it yeah okay okay you know it is what is it is foreign very last name cheers oh so uh she also said that he suffered from epilepsy yeah that's what he's saying that he uh that she believes that it's this medication that makes him go into this altered mind into the same group like being angry okay that's what she stated uh okay all right so he's stating that he was sitting down eating and that the dogs were going up to him because he obviously was eating and they defend the dog seat go by the Casey leave them alone and as a mom started getting upset with him and saying hey don't be screaming at the dogs like that so then they started arguing she then proceeded to grab a broom and started hitting him with a broom and then he was trying to stop her from here with the broom so he's put his hands out and that he grabbed everything thumb he grabbed his hand and bitter hit his thumb but how did he train I told him so how did she get scratched on their neck and face he says from defending me I was just trying to block the hits so it was scratching can you ask him where he got hit at if he got hit from him um pushing her back scratching at the same time anyway do you have any did you ever get here you never got hit too easily a bit right yeah I'm not really useful yeah that's amazing medical attention are you fine okay it's okay okay he's very shaky yeah I mean he's epileptic I don't know what the other symptoms of Silence usually but yeah I previously not a stable condition kind of hard to tell me I need to turn around and find it back behind your back yeah well as smart defense attorney well I follow this person last year she needs to talk to you but who mom don't work is that Mom yeah all right yeah oh 20 year old David espinal was arrested on one misdemeanor charge of assault on a family member if convicted he could face up to a year in prison where they look around what they want to take off first yep I'll explain we're gonna say anything to you in a minute okay those things and I asked them to ask him what what's his dominant hand so his dominant hand is right right the marks on her neck are on the left side which means that she he would have had to go like this or like this right and when he when you choke someone you choke like this right to the left right yeah you're gonna grab like that and all the marks are spread out like he was going like this that's it looks weird yeah but uh this just he couldn't like he like when we were talking to him earlier before I got it he couldn't articulate anything he couldn't him yeah yeah he couldn't articulate why he did like where the Mars came from no no I'm not doubting it I'm just saying they look weird so I don't know she said when he went down on the he went at it with two hands yeah and so I'm assuming maybe he tried to get the right one but the left one got first and she held this right one back maybe maybe but uh yeah continue it should be continuous even if yeah it was on my birthday the last time yeah huh this year he went to jail he went to jail in Louisiana for a family that part or it was him insulting her so I mean it's standing in violence oh God he said it was for smoking weed but when you read the paper that she has yeah it says this year 222 22 um that's all huh for uh for the like the Paris jail on there I didn't see the jail which one is where you went like he's like an incident form or something like this it's like a whole Court Document okay I'll call back and get that I didn't know that part yeah I just knew that here so they're losing but I didn't know like he got charged I didn't know that too he got arrested for it okay I'll give her a call back though I thought that was for the brother now no she she said it was him she said it was him oh damn got arrested on 220 yeah and he got released two two days later can you uh so she knows you're going to jail uh huh okay uh tell her I asked to get the key back but he wouldn't give it to me and I can't take it away from him because it's on his person who's his property so what she needs to do is get the door lock changed uh from the apartment complex you had to pay 50 but she needs to get a passport video yes sir I think he has pictures ask you to see what an emergency order to uh just wanted him not to come back here like we're offending order okay we're taking him to jail are you already told him that can you explain something real quick that we're taking them to jail okay don't do nothing stupid then he'll get in and out quicker if he's exhale foreign okay what time of night do you know what kind of medicine he takes what's it called I can go take a picture for tomorrow take a quick picture of what it is so I can tell the jail what yeah I need it because I gotta I gotta go take a picture of his medication here I just I guess as far as so just tell them basically he got arrested in Louisiana right uh on February 2nd you have the charge date and everything with his exact name and date of birth that matches what we have here and that he was charged in Louisiana for it before oh you got it yeah it's like two moments I appreciate it I gotta take a quick picture of the medicine somebody call out let me give him a rep resent yeah probably who's you riding with by yourself um yeah he was wrong with uh him and that's I heard of the boat was in the chicken behind a
