Welcome to Texas Law Encounters. On August 16th, 2022, officers were dispatched to Houston, Texas in response to a domestic disturbance. Upon arrival, officers met with the complainant who stated that the defendant is her biological son and they live in the same household. The complainant reported that a verbal altercation occurred between her and the defendant in their household, during which the defendant became irate and physically assaulted her by pushing her with both hands, causing her to fall to the floor on her back. While lying on the floor, the defendant sat on top of her and attempted to strangle her by reaching towards her neck and face with both hands. She was able to pull and forcefully slide away from the defendant's grasp, preventing him from successfully strangling her. However, the defendant continued to grasp at her neck, causing multiple scratches on her face. In an attempt to stop the defendant from strangling her, she bit the defendant's right thumb, allowing her to break free and call the police. Upon inspection, officers observed multiple visible scratch marks with fresh blood and bruising on the complainant's right cheek and lower neck. The complainant reported feeling pain after the assault occurred and positively identified the defendant as her biological son who physically assaulted her, causing bodily injury and pain. The responding officer observed visible wounds on the complainant's right cheek and to the right side of her neck. 20-year-old David Espinal was arrested on one misdemeanor charge of assault on a family member. if convicted, he could face up to a year in prison.
