Okay. >> We have a witness telling us that you're taking liquor bottles out of the car and slow down. >> Were you drinking tonight? >> Okay. So, I'm going to run you through some tests. >> Mhm. >> Okay. All right. So, honesty goes a long way here. >> Mhm. >> So, if you drank today, you better tell me now than make me run through all these tests and then determine it afterwards. >> Okay. >> So, did you did you drink tonight? >> No. >> Okay. County, I'll be running one through test. >> Around 5:30 to November 25th, 2024, Officer Craig Sisnowski with the Freehold Township Police Department responded a threecar motor vehicle accident in the area of West Main Street and Schleviguay. He arrived on scene and made contact with a female who was identified as the driver of a light 2023 Nissan Sentra. The Nissan Sentra was totaled while a 2013 Dodge Caravan and 2024 Hyundai Santaare had also sustained significant damages. It was later determined that the driver of the Nissan Sentra struck a Dodge Caravan that was stopped in traffic and the Dodge Caravan subsequently struck the Hyundai Santa Fe base on the impact of the crash. The driver of the Hyundai Santa Fe complained of back pain resulting from the collision. Ma'am, come with me. >> 2564, you can stay available. >> All right. What? We're going to go right there cuz it's level. All right. All righty. You see this line? I want you to put your feet together on this line like this. Hands at your side. We're going to be facing this way. Okay. All right. All right. Feet together all the way. Hands to your side. All right. Have you had any head injuries lately? The driver of the niece on Centra was identified as 22-year-old Beatatrice Urguia as he started speaking with Beatatrice. Officer Sisnowski detected the odor of alcohol and observed other indicators of impairment. Beatatrice denied consuming any alcohol, but the officers were told by others that she had discarded open containers of alcohol from her vehicle. Based on his suspicion of impairment, Beatatrice was asked to perform field sobriety exercises. >> Yes. >> What did you have? >> My ex-boyfriend. Yeah. Me. >> I mean, did you have a concussion? Did you? No. >> Okay. So, no traumatic brain injuries? >> No. >> Okay. Any issues with your eyes? Do you have any eye conditions? Do you wear glasses? >> No. >> Okay. All right. >> You see the tip of my pen? Mhm. >> I want you to follow that with your eyes only. Do not move your head. Do you understand what I'm telling you to do? It's going to be two quick passes and then we're going to go to something else. Okay. Nope. Keep your head straight. Do not. >> The first exercise was the horizontal gaze nestagmus HGN test. During the HGN test, officer Sysnowski observed the lack of smooth, distinct, and sustained nestagmas at maximum deviation and the onset of nestagmas prior to 45°. The second exercise was the walk and turn test. During the walk and turn test, Beatatrice did not touch heel to toe on each step, took an incorrect number of steps, and turned improperly. Despite multiple attempts, the test was not completed successfully. Officer Cisnowski decided to not attempt the one leg stand test. >> Not turn your head. Eyes only. Don't turn your head. Keep your head still. Okay. Now, I'm going to take it to the side. I'm going to hold it at max deviation. You might not be able to see it. However, I want you to keep looking the direction the pen is. Okay. >> Perfect. >> Did you bite your tongue when you uh or bite your whip when you got in the accident? >> No. >> Okay. Heat. Heat. Copy that. Thank you. >> Okay. >> Okay. But when a witness says that you're running from your car and dumping [music] something somewhere and then walking back to your car, we have to dot our eyes and cross our tees, right? That's that's that's all this is. >> Okay. All right. So, pay injuries with your legs. >> Okay. So, what I want you to do, you see the line in front of you, you put your left foot down and put your right Yep. >> right. >> Yep. And right is going to be touching heel to toe. Keep heel to toe in front. Nope. Touching the toe. Okay. Hands at your side and you're hold that. Nope. No. Go back. Go back. >> Put your No, I'm telling you, put your left foot on the line and you're going to put your right foot touching heel to toe directly in front and you're going to hold that position. I tell you tell you to start. All right. And keep your hands at your side. When I tell you to do so, >> left to toe. >> Yes. Just like that. All right. When I tell you to do so, you're going to take nine heel to toe steps along that line. All right. When you get to your ninth step, you're going to keep the front foot planted. So, you keep that foot down. You're going to take a shears of short choppy steps like this and resuming nine. I'm going to show you how to do it. >> Wait. Okay. Show me how. >> Get back in the starting position. 1 2 3 and so on till nine. Get to the ninth. You're going to leave that foot down. Serious short choppy steps and back. back nine. 1 2 3 and so on until nine. Make sure your toes uh toe and heel touch and your hands are at your side. All right. When you're taking your steps, you're going to count them out loud. All right. Do you understand what I'm telling you to do? >> Take nine steps. That's fuel. >> You had nothing to drink? >> No. No. >> Okay. I didn't tell you to begin. Put your left foot on the line, right foot touch. All right, you may begin. Seems like more than nine steps, right? You're not proving it right now. I'm telling you what you need to do and you're not doing it. >> No, you didn't. >> Go back and retry. Okay. Do the hi. Get in the starting position. >> Huh? I know. >> Okay, ma'am. >> Was that how I showed you how to do it? >> Yeah. You said one heel on top of the other. >> Okay. And what else I say? >> On top of nine steps. >> Okay. And then what were you supposed to do once you reach the ninth? >> Stop. >> No. >> I showed you what you wanted to do. This is your last attempt. Try it one more time. >> I will show you exactly what I want you to do. >> All right. Get back in the starting position. >> As soon as you get in the starting position, left. Remember the right foot. Yep. Left foot down. Right foot touching. Heel toe. All right. One, two, three, until you get to nine. When you get to nine, keep that foot down. So, there's a short, choppy steps. Back nine. 1 2 3 and so on until 9. Make sure you count your steps out loud. You may begin. Okay. All right. Stop. Stop. Stop. You still want to say you didn't drink anything. It's a very simple test that you can't follow. I'm I'm I'm trying to be straight up with you. >> I can smell the booze coming off your breath. Based on the motor vehicle crash, the odor of alcohol, the open container in her vehicle, and her inability to complete the field sobriety exercises, Officer Sysnowski placed Beatatrice under arrest for driving under the influence. Her vehicle was impounded for a 12-hour hold according to J's law. Officer Sysnowski transported Beatatric to the Furryhold Township Police Department for further processing. You said n step. >> Yeah, your car's your car is done, dear. A lot of people get back to the door. There are injuries. One guy, please. One person wants to handle the crash. I'll handle a DUI. >> The witness. Did anyone get the witness's info? Okay. The witness. I got the homeowner the first >> uh 13 should be the first one in the stack. >> Where are your documents for your car? >> I'm I'm going to patch you down with real quick. All right. >> You don't have anything on here? You have any pockets I don't know about? >> I have your phone. I have your phone. All right. Just take a seat in there real quick. Okay. >> Where do you normally keep your documents for your >> Oh, I have to search the car anyway. Sorry about that. >> Why? I'm going to need that plane again. >> It's a taxi tag. Oscar tango 650 alpha. >> I don't know. Are they? >> Oh, yeah. >> All right. All right. So, you're going to take the DUI and I'll take the crash. >> Yep. That's fine. >> All right. So, you got open container as well? >> Yes. Um, are there injuries? >> Yes. >> All right. So, I uh vehicle assault. >> Well, he's not going to hospital. >> Still the driver of the uh her car keys. >> Her car keys are right here. One more velocity. I am 14. What's your location and where I'm red? Any more? >> Just the one that was on the floor right next to the driver's seat. She was over here somewhere. >> No, we found it. >> Oh, you found it. >> Yeah, but even that is enough. >> Yeah. No, that Yeah, that was that was that was right outside the driver door. >> See this you see this black car through a bunch of white claws. >> I can smell it. I can smell it coming off her. >> Yeah, she's here. >> And there was injury. >> There was injury. So, her vehicle assault, too. >> Is this part of the van? >> No. No, no. This is the registration for with the insurance. Yeah. >> All right. Perfect. Thank you. This is this. >> Yeah. Perfect. And does she have any uh elements? >> Uh is she? >> I haven't even got anything yet. I'm assuming she's RO. Let me check. I didn't get that far. Miss, is that car registered to you? Is your car okay? >> I don't know. >> Is that a car? The white one? >> Yeah, she got DUI. >> And vehicle assault. She injured another party. >> She's already under arrest. You can't talk to her. >> Roco. Roco. >> This is dad of of this one. and I'll give you a case. >> Thanks, Frank. >> Yo, >> Sarge. >> I'm I'm going to take her headquarters. Yeah. Yeah. She's the hola. Hola. Officer, I'm really nervous. >> I'm sorry. >> I'm really nervous. >> Where's your purse? >> 21. >> It's in my car. Do you have my phone and everything? >> I have your phone right here. I >> And in my license. I have my license and everything in my car. >> Okay. What What bag is it in? >> It's in like the driver's thing. >> Can I show you? I'm not a bad person. Like, I'm not gonna do anything. >> I'm I Listen, I It's just We're dictated by policy right now. All right. I gotta get your ID. >> Rio notified. >> You got my >> I have your phone. The other officers didn't grab your stuff. >> You have my license. You have my um debit card. >> The debit card? >> Mhm. >> Is that the one that's in the box? >> Please get it. Yeah. Can you please get me to tell your dad? >> No. Can you please get it out? >> Oh, he's already here. >> My dad's here? >> Yes, he's right there. >> Okay, [crying] Jake. Yeah. In in the glove box is a debit card. Just have her dad grab it or >> Yeah, I don't. She wants it. I don't know. >> Am I in a lot of trouble? >> 589. I'll be transferred to my health to headquarters. Starting mileage 439. >> Are you in trouble? You're in a fair bit of trouble, ma'am. >> I've never been in this much trouble. My wife. >> Am I going to be arrested for life? >> Ma'am, you're already under arrest. [laughter] >> Arrested like this ever. This is >> Can you be honest with me? >> Yes, ma'am. Like how bad of trouble am I am in? >> Well, you got you're getting charged with a DUI. >> Okay. >> And you're most likely getting charged with vehicular assault cuz you injured another party. >> Okay. >> During the course of a DUI, there's going to be some paperwork I got to read to you when we get back there. All right. Am I going to get to jail? >> Probably not. There's >> always the chance though. >> Okay. >> 2589 1093. >> Just a lot of problem. >> 440 tac one. >> Sorry. Just like a lot of problems, right? Like I'm going to get probation and stuff like that. >> You're going to lose your license for a bit. >> Okay. >> And then I don't know what the other charges are going to be. To be honest, from what you've seen, please tell me as like as a person and stuff like that. What do you think is going to happen to me? >> I honestly I can't tell you cuz each situation's different. A lot of things go into it. >> If I could tell you, I wouldn't. But I really don't have an answer for you. >> What did my dad say? >> He was worried that you were hurt. At the station, officer Sysnowski read Beatatric the standard statement for motor vehicle operators and she initially agreed submit breath samples. However, she later refused to submit breath samples when the machine was ready. After the officers finished processing her, Beatatrice was eventually released to a sober adult pending her court appearance. Oh, I'm going to reach across you. I don't I'm not just trying to get you unbuckled. Where did they put They didn't put it. Okay, hop on out. help. >> Okay. You want help? >> Okay. Just keep sliding. Keep sliding. Keep sliding. Get your feet down. I'm going to get those cuffs off you when we get in there. Okay. >> Hopefully, this is the only time. All right. Let me see those cups. Have you seen this often? >> What do you mean? >> When I move girls my age. >> Dwey all the time. >> All the time. >> How old are you now? >> I'm 22. >> Really? >> All the time. [laughter] >> It happens. >> Even with the car getting total. >> Totaled. Oh yeah. >> It's not the worst I've seen. >> Okay. I found this on the way. >> Everyone's okay, right? >> Well, you you hurt someone. >> What do you mean? >> Someone got hurt. They hurt the back. That's why you're getting probably going to get charged assault. >> Really? >> Yes. I'm not lying to you. >> I don't know. Let me see. I [ __ ] hate this. >> Yeah. Listen, if I was in your shoes, I wouldn't be happy to be here either, you know? But actions have consequences, right? >> You think I I'm not going to go to jail? >> I don't think the girls jail's going to take you cuz you're drunk. >> What? >> I don't think the jail's going to take you cuz you're drunk. >> What do you mean? >> They usually don't take intoxicated people. And also, you've never been arrested before. >> No. >> All right. So, you probably own home. I would say 9010. Do you think >> Do you think we're in trouble? >> Patriots, you're already in trouble. >> It's already happened. All right. >> I'm just being I'm being upfront with you here. >> Yeah. >> All right. I I figured you'd appreciate me being honest. And >> I like you being honest. >> Okay. So, I'm going to read something. All right. You have to listen to me. You've been arrested for driving while intoxicated. NJSA 394-50. The law requires that you to submit samples of your breath for the purpose of testing to determine alcohol content. A record of the taking of the breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. After you provide samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. The court may find you guilty of both refusal and driving while intoxicated. If a court finds you guilty of the refusal, you will be subject to various penalties, including license revocation of up to 20 years, a fine of up to $2,000, installation of ignition interlock, and the referral to an intoxicated driver resource center. These penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty. You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Any response from that from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing. Even if you agree to take the test but then do not follow my instructions, do not properly perform the test or do not provide sufficient breath samples, I will charge you with the refusal to submit breath testing. I repeat, the law requires you to submit samples of your of your breath for testing. Will you submit samples of your breath? Um, okay. Can you repeat that? >> Which part? The whole thing or just the last thing already? >> About the breath? >> I I repeat, the law requires you to submit samples of your breath for testing. Will you submit samples of your breath? >> Why would the law want me to submit samples of my breath? >> Okay. Can I go to the bathroom? >> Nope. >> I just explained 20 minutes. >> All right. So, your answer is not acceptable. The law requires that you submit samples of your breath for breath testing. If you do not answer, answer with anything other than yes, I will charge you with refusal. Now, I ask again, will you say yes? >> Okay. 258. Can I start 20 minute observation time >> you ever hear the Miranda warning before? Your Miranda rightites? >> No. >> Okay. So, are you a righty or a lefty? >> I'm a righty. >> Righty. Okay. So, you have the right to remain silent and refuse to answer any questions. Just need your initial there that these are just that you're being advised of this. Anything you say can be used against you in the court of law. You have the right to consult with an attorney. >> Wait, my phone? Like where's my phone at? Dad, >> phone's right there and it's off cuz it kept vibrating. >> You have the right to consult with an attorney before speaking to the police and to have an attorney present before and during questioning. Okay. If you do not have the money to obtain attorney will be obtained for you at no cost to represent you before questioning. The decision to ren these rights is not final and can be revoked when you desire before or during questioning. Do you know what that means? >> No. >> It just means that you can stop talking whenever you choose to. All right. In layman's terms. Initial on this line. [snorts] Okay. Having this in mind, I certify the notified of my constitutional rights as indicated by my initials above and that I understand these rights. I need you to sign there. Having in mind these rights, I desire to renounce them and give a voluntary uh declaration and answer any questions. If you don't want to, you can just leave it blank. If you want to speak to me, you can sign it. >> What does that mean? Like I don't want to miss right now. >> It means that you understand the previous rights that I told you. So, you have the right to remain silent and you're waving that and you want to talk to me. All right. So, if you want to talk to me, you sign it. If you don't want to talk to me. Okay. All right. So, like I said, >> my phone, please. >> You cannot. You're under arrest. >> Yes. Really? Um, you know, like I said, 20 minutes, no touching your face, no burping, no belching. If you need a tissue, I'll give you a tissue. >> Can I go to the bathroom? No, because then we'll have to restart the timer. [snorts] >> You want to contact? >> It's another >> Can you hold off for another 18 minutes? >> Yes. Okay. >> Who's going to pick me up? >> Uh, your dad's going to have to come get you. He's got to sign paperwork saying that you're not going to drive. >> Okay. My car is run >> very. >> All the airbags went off in it. You say you see this often? >> Uh, almost every day. >> Every day. >> Mhm. People make mistakes every day. >> I feel really shitty for this. >> You should You should feel shitty. >> Yeah. >> It's good to have killed someone. So yeah, you know, I'm just being real with you. Like, you know, I'm 36 years old and I've never gone to that point. >> What advice do you give to me? >> Don't drink and drive. >> There's Uber now for a reason. >> Yeah. Anything else? >> Well, besides don't drink and drive, don't dump the liquor bottles that we obviously know you're dumping. I'm just being real. Why? We're not stupid. Especially when you have people pointing. It happens. It's all right. Listen, no one's dead. All right? Just stay on that. Someone got hurt, but they're not dead. All right? >> You know, just use this as a learning experience. >> Well, they said they got hurt with >> from your car hitting their car. >> No, but what they said >> their back. >> Their back. >> Mhm. >> You can get injured in a car with as little as 15 miles per hour. >> Really? >> Mhm. What did my dad say? >> Uh, he was just worried that you were hurt and we told him that you were not. >> What did he say? >> He looked scared. His daughter just got in an accident. I'd be scared, too. Yeah. You still live at? >> Yes. >> Okay. >> Why? >> Because I'm filling out paperwork. Just has to have your current address. >> I'm really sad. >> I would be too, but it could always be worse. >> Really? You think so? >> Oh, 100%. >> Really? You could be in that chair and someone could be dead and be charged with murder. >> Yeah. So, you know, >> it's not great. >> It's not great, but it could always be worse. Do you have a license, too? >> I do not because your I checked your your car. I didn't see it in plain view and your debit card was in your uh glove box. >> Both they were both >> They were both in there. Okay. So, if if it was there, the other officer is going to bring it. I don't have insurance >> on the vehicle. >> Mhm. >> Really? >> When did you cancel your insurance? >> Um, last month. It's still saying it's valid here. >> Yeah. Still says you have insurance here. >> Okay. If it says I do, >> maybe you paid up till the end of the month. >> Okay, I guess. What happens if I don't have insurance? >> You get more tickets. >> So, it says I have insurance >> saying that the registration's uh valid. >> Okay. Good. >> It might have just not gone into effect. I highly recommend that you get insurance because >> I I do want insurance. I just like it's hard for me to afford it because uh I pay for everything myself. >> I understand. But the thing is if you don't pay your insurance then your license is going to get suspended and then if you get stopped you're going to spend 10 days in jail. >> Oh my god. No. 10 days in jail. >> And also now you are liable if you don't have insurance. If you really don't have valid insurance, you are liable to pay out pocket every dollar of damage onto the other vehicles. So that's why we have insurance so we don't get put in these situations. Okay. But it's it says I have insurance, right? >> Says it's valid right now. >> Okay, good. >> Yeah. >> Great. >> I'm assuming you were coming from work. >> Yeah. >> Okay. >> [clears throat] >> Can I go to the bathroom, please? So, it's been >> you have another 10 minutes to go >> and then you have to >> pump it back, please. >> You're killing me. Do you forget what I'm I told you? >> I know. I >> You just completely forgot what I said. >> No. >> I said you're under arrest. You don't have access to your phone. >> Okay. And I also said that if you guys need to go to the bathroom again, I'm just going to take you to the bathroom and reset the timer again. >> Okay. >> All right. You have 9 minutes and you provide your breath samples and you go to the bathroom as many times as you want. >> Wait, can you see if um someone called Clayton texted me? >> I think you have other things to worry about right now. >> No, >> you can handle that when you get out of here. I'm I'm being real with you. >> Yeah. >> All right. Like this whole thing's on camera. Like You say you like you do this like every day? >> At least one of us does. Yeah. >> What do you think about it? >> In what aspect? >> I don't know. Just in general. >> Shouldn't be drinking and driving. >> Yeah. You know, you and I both know that you knew you shouldn't be driving. >> Yeah. >> So, you know, I'll I'll leave it at that. I >> think tomorrow when you sober up, you should probably look up the number of fatalities from DUI in the US. >> Yep. Why do you think there's so many young women that have DUIs? >> It's not just young women. It's just young people in general. >> Why? >> Cuz they don't know their limit and they think they know better and they think they can live forever. They don't think it's going to happen to them. You know, >> there's nothing wrong with having, you know, a drink or a beer after work. There is a problem when you're getting to the point that you're slushed and you cause an accident or you're slashed and you're just driving and you really shouldn't be. You know what I mean? Z1 103. So I can turn on the box. four mile five. >> All right. I'm going to ask you a bunch of questions. If you don't know the answer, you don't have to answer. All right. Are you wearing a false teeth, invisible braces, or a mouth guard? >> No. >> Okay. >> No, I just need someone to sit with her so I can turn it on and start entering the stuff. I'll be there. Cleaning up now. >> All right. I see. Thank you. Were you operating a vehicle? What are you talking about? >> I'm asking were you operating? These are just questions that we ask if I'm >> skip. >> Okay. >> Where were you going? >> Skip. >> What street or highway were you on? >> Skip. >> What direction were you traveling? >> Skip. >> Where did you start from? >> Skip. >> You going to skip all of them? Just tell me now cuz I'll write skip on the whole thing. >> I don't know. I don't know. >> There's a lot of questions. >> I don't know. >> All right. Where did you start from? So, where did you start driving from? >> I don't know. >> What time did you start? >> I don't know. >> What time is it now? Without looking at that clock. >> I don't know. >> All right, we're going to write on it now for everything. >> You're so mad at me. >> I'm not mad. I'm not mad at all. Actually, it's saving me work. >> Okay. That's done. 21. >> Vehicles are off the roadway. I'll be heading 103. Okay. Good. Or what? >> His bathroom. Now you're just messing with me. >> What? >> You're just messing me with me now. [laughter] >> I know. >> I'm not even going to acknowledge that one. >> I'm the bathroom, but like I'm really like really bad. >> Can you hold off for another 5 minutes? >> Uh, >> or do you want to do you want to restart? >> Okay. [laughter] >> No, I'm joking. I'm joking. >> Do you need to go or No. >> Do you need to go? Come on. All right, go ahead and take a seat. This is Officer Hernandez. He's going to hang out with you for a little bit. Is this actually common? >> Uh, what? DUIs or >> DUIs? >> They're common. >> Yeah, people drink and drive. You know what I mean? >> Yeah, >> it happens. But uh for reporting purposes, I'm doing the I'm handling the crash portion. >> All right. You already gave her Miranda, right? >> Yes. >> All right. So, >> I just need in your own words exactly what happened with the crash portion. >> Um just like um the break just went off a little bit like you know, I'd rather not talk about it. I'll talk about later. >> Okay. >> You guys didn't find it, right? >> No, >> but >> I have it. It's easier to scan. >> Print it. >> You have to the same thing. What? >> I'm just waiting for this to load. [laughter] These computers are >> What are you looking for? >> I had to do a bunch of paperwork, you know. >> Yeah. >> [laughter] >> You all right? >> Yeah. I'm all right. >> That's all you want to say? The brake just slipped and you'll talk about it later. >> That's your statement? The brake slipped and you'll talk about it later. Okay. >> Yes. >> Okay. [laughter] Why are you laughing? Not really. I'm laughing this right now. [laughter] Okay. [laughter] You're laughing at me now. [laughter] >> No, I'm literally not in a laughing situation right now whatsoever. [laughter] >> I don't think it's funny at all. >> I don't think it's funny either. [clears throat] You just like got into a car accident. Are you okay? You hurt it all? >> No. >> Okay. [cough] Is everyone okay in the accident? >> Yeah, everyone's all right. Okay. >> One person was just complaining a little bit of pain, but everyone's okay. >> Okay. >> I didn't like sex in my stomach cuz like basically ruined my car. >> Yeah, it's total time. Craig, did you do uh like your non-custody everything? >> Not yet. >> Can do it. >> I need to rip out the other stuff. I've been trying to just get everything else done. >> I'll do the non-custody >> because I don't know this. Sergeant LC coming here or are you >> I don't know about the other thing. >> Okay. I don't I don't know. >> That's like the thing like >> Yeah. >> What's the other thing? >> The vehicle assault that I told you about. >> Oh, >> cuz somebody got hurt. >> Oh, >> but I don't know. >> What do you mean? >> You can get charged with assault with a motor vehicle. >> What is that? Like what does that bring?
