on the early morning hours of July 4th 2024 in Dell nort County California Highway Patrol officers were patrolling Highway 101 in Smith River California when they observed a car pull out from Beckstead Avenue in front of another car and almost cause an accident hello there front of that car back there okay well the highway they're going at least 6560 your license sure for uh have off today we had a little in tonight and then call yeah few hours ago I know it was baby baby hour ago we trying to trying to leave supp yeah up okay my you mind hanging out the car for me please back by the wheel okay 88 North West to 101 um are you diabetic you need okay what happened to oh yeah um normal last night yeah how many hours what time [Music] okay what time was that take your first one [Music] uh what were drinking white and then when you do stop take your last I like eight that's right after um when you started driving in CR C that's correct and where you headed right now oh had it all no okay head trauma then um are you care of a doctor or than regular your doctor where she PR all right um you know you're stopped right now you're okay to drive I see little evidence of something maybe still lingering in your system there as far as alcohol repairment concerned front of the car so I just want to make sure you're okay you know sometimes things like that happens where we have the LA to you know judge it but I just want to make sure alcohol C so um while we're doing test together just like L and then your arms down sides like that um but I'm going to explain and demonstrate all these tests to you I don't want you to start or begin a test unless I make it clear out start or begin okay so um the first step is going to be follow my finger with eyes eyes okay okay my finger you close your eyes once your eyes are closed I'll say start when I say start I want you to keep your eyes closed for 30 seconds okay when you think 30 seconds this pass I want you to open your eyes your off the ground I'm going to demonstrate by raising my right foot okay but so when I tell you to what I'm going to have you do we're going to lift one foot off the ground approximately six in like mine is keeping your legs straight like mine are you're going to stare at your raised foot be little to the ground not pointing up like this like this St at your right foot with your arms to your side like this one23 does matter with it doesn't matter no yeah no it doesn't matter you can do either one um but just make sure you're raising your foot staring at your toe arms at your Sid and you're counting like I told you okay takes about 30 seconds but I'll tell you when to stop let me get my watch you know you understand that that yeah B 1001 you're going to lift which foot off the ground well I here I was left messed up a little bit okay whichever one you feel comfortable I want to do my left but I don't want to I don't know your my left either one one you go with that go ahead and begin I show you thate y all one more test for the preliminary alcohol screening test uh the only test for alcohol is to further system me determining whether or not you're under the infut of alcohol or how much is in your system um it's just not a buil toiy test um can refuse to take it if you're not on gy probation and if for whatever reason you're arrested you still have to submit to a chemical press BL test it's not a official chemical test in the state of California do you want to do that one real quick like the you don't have to take it just like another F like we if I know then what well what I appear to be the inflence I have to go by you want to do it or no I mean not no one wants to do it true you want to see where you're at depends if you're over the legal limit obviously you get arrested but what I've seen so far be performed I believe I mean I I know that's again all that stuff that you told me and all the questions that we driving and all the tests we just did help me form an ATT this one just further assist me in in determining the actual alcohol content so like I said again take it another you don't want to take it I don't want to I'll probably you under left you do it nobody wants one you I know why I not that long in the milary you want list here's the thing you already heard what he said right yeah so if you take the prelimary alcohol and you're under the legal limit you're under legal limit right yeah basically I mean what he's explaining to you is that that test really isn't in a hurt anym I know but what if I'm like8 what if I am 08 well you already explained to you what the reifications that you de right basically which is not something he would normally explain to you pretty nice and all that okay but you know it's it's ultimately your choice we're not here to sway you really but it's something that we ask everybody to take I mean he would have arrested me either way well you are showing signs of but this is not the required test by California I know you explained that you likely take it but since you are taking it if you are still arrested after you would still be required to take a second actually so how how we do this one we do one breath sample we wait two minutes and we do a second um so to do the test you just take a deep breath and strong steady breath so needs a lot of air okay like Bady they said you appli to here in the military I am in the military you yeah what do you do in the military where you f my life my life is pretty [ __ ] up to be honest and uh I just I went back in AUST and uh nurse too I am a nurse well what what don't you do I know and uh I don't know nothing's working out how I would like it to so I decided to was no actually you want I'm going to finish the 20 oh you are that's the goal anyway so you go so if you dop it stay on yeah do your service every month or so whatever I don't know well yeah but trying to make it better I just back here Virginia because of a lot of [ __ ] trying to I don't know get it together make up in thing for reason all right want where you're sitting first was a one .121 the second was a 0.123 legal liit in California you may know over that so yeah I me put your hands on your back for me we'll make sure you get well uh if you're okay with the car being here the car is here off the road safe place we'll make sure you get take the way he all right yeah someone can pick you up or no uh you need uh back want you right to back yes we can do that you have any weapons on you have to check before throw you in the car with us okay I can up to something real the breath machine in the caright jail you do the yeah yeah yeah well we got to do it that so do you want to knock out the one we have here or do you want to go to the C coast and get a submit to a test if you don't do a chemical breath or blood test you lose your license automatically for year without any criminal proceed without your case being by Court license c um I do a form to if you want to refuse testing you refuse testing again we have to go get a warrant a warrant have to go to the hospital get a blood draw so with ready fight that we're going to get a test but it's all matter if you want to do like I said we have the breath test here the one you just did take two minutes out a little rece or we your with test you perform you only have to perform one bre test I see it first okay I see it first not under the seat the phone no okay she say it's under the seat side do the all right than it first [Applause] is watch right now i i f think well all right so this is the same as the other one it requires a big long steady breath and a little beeping noise and then it stops when it's done but don't stop breing out through the tube until it stops okay we get this done the quicker we get this four hours okay breath [Music] so this machine is smarter than you and I so it's going to be able to tell if you cut your breath short if you don't blow hard enough okay blood test if you want to something to test later as the machine we use does not save a sample of your breath or blood to test it a later date for your defense um so we can go to sou Coast get additional test want just know that that test can be tested by the prosecution as well evidence against you you want to go do an additional blood test go just the answer no question e
